The Department has received and proposes to approve a request to extend, for 3 years, the existing waiver allowing the applicant to use coatings that do not comply with volatile organic compound (VOC) content requirements of 6NYCRR Part 228. The company has provided documentation that compliant coatings which meet their specific requirements are not available and that the cost of installing a control device significantly exceeds the cost threshold for Reasonably Available Control Technology (RACT). The applicant has a State Facility Permit which caps VOC emissions below the major source level and has requirements which further restrict the amount of non-compliant coatings which may be used. Project Description: Applicant proposes excavation of 994 cubic yards of sediment and debris material from a man-made pond that has silted in over time and evolved into wetlands. Erosion and sedimentation controls are included in the project proposal. Disposal of excavated materials will be at the Town of Bolton landfill.
