The applicant proposes to
construct approximately 364,000 square feet of commercial
building, including a large super-center retail store, a large home improvement store, a
restaurant, a fast food restaurant, a bank and associated parking.The proposed 75.78 acre
site is located on the west side of US Route 9W between Bender Lane and Route 32, in
the Town of Bethlehem, As a result of the proposed project 1.99 acres of federally
regulated wetlands and 2,785 feet of federally regulated stream channel would be
impacted. As mitigation, the applicant proposes to construct 2.94 acres of wetland
mitigation and 456 linear feet of drainage channel. A stormwater management report has
been prepared and the applicant will be required to obtain a State Pollutant Discharge
Elimination System Permit (SPDES) for Stormwater Discharges from Construction
Activities.

construction of a 51 lot subdivision on a 35.64 acre parcel
located at 113, 115 and a portion of 129 Fonda Road, in the Town of Colonie. As a result
of the proposed project, there will be permanent impacts to 0.48 acres of federally
regulated freshwater wetland and to 195 linear feet of defined tributary. Additionally,
there will be temporary disturbance of 99 linear feet of tributary and 0.05 acres of
wetland associated with the installation of potable water and drainage for the
subdivision.The applicant will be required to meet the requirements of the New York
State Department of Environmental Conservation State Pollutant Discharge Elimination
System (SPDES) General Permit for Stormwater Discharges from Construction

The Department has proposed
an Air State Facility Permit for the application that was
received for the HansonQuarry & Asphalt Plants facility located on 7904 State Highway
Route 5, Town of St. Johnsville, County of Montgomery, owned by Hanson Aggregates
New York, Inc., 4800 Jamesville Road, Jamesville, New York. The facility is involved
with the mining and processing of dolomite rock as well as the production of hot mix
asphalt. The facility includes generators, equipment used to mine and process dolomite
rock (including crushers, screens, bins, and conveyors), and hot mix asphalt plants. The
proposed Air State Facility Permit will combine the company's two currently existing Air
State Facility Permits (4273800004/00012 and 4273800004/00015) into a single permit
and will also restructure the existing emissions caps. In order to continue to remain
below the applicability threshold for Title V permitting, the applicant has proposed
restricting the potential to emit through enforceable permit conditions which will limit or
cap emissions at a level which is less than 100 tons per year for each Oxides of Nitrogen
and Carbon Monoxide. The applicant has agreed to permit conditions which will limit
Oxides of Nitrogen and Carbon Monoxide by restricting the hours of operation of the
generators and the production of hot mix asphalt. The facility will be required to
maintain records and report this data to verify compliance with permit conditions and
limits.
Persons wishing to inspect
the subject Air State Facility files, including the application
with all relevant supporting materials, the draft permit, and all other materials available to
the DEC (the "permitting authority") that are relevant to this permitting decision should
contact the DEC representative identified in this Notice. It is recommended that an
appointment be made to confirm the availability of the subject files. The DEC will
endeavor to make the files available within two business days of contact, during normal
business hours (8:30 AM through 4:45 PM), unless the requester wishes to inspect the
files at a later date.
