treated vehicle wash water to Mill Creek, a Class C stream, from a grit chamber and
oil/water separator treatment plant at the applicant's Conewango Sub-Headquarter's
facility located at 5732 Route 62, Conewango, New York. The facility also has a 200
GPD (maximum) treated sanitary wastewater discharge to groundwaters, (Class GA).
The
Department has made a tentative determination to issue a permit for a State
Pollutant Discharge Elimination System permit under Article 17 of the Environmental
Conservation law. This tentative determination indicates that the discharge regulated
under this statute is considered to satisfy regulatory standards for permit issuance, based
on information available to the Department at this time. As a tentative determination, the
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. As such, this tentative determination does not signify
department approval for or endorsement of the activity for which a permit is sought or for
the overall proposed project.

A
modification to SPDES Permit No. NY-0003395 is proposed as part of the
Environmental Benefit Permit Strategy program for an existing discharge of 137,000
gallons per day (Maximum)(GPD) from Outfall 001 of Treated Process and Contact
Cooling Water, 2,000 GPD (Maximum) from Outfall 002 of Non Contact Cooling Water,
and 3,000 GPD (Maximum) from Outfall 003 of Emergency Overflow Contact Cooling
Water. All outfalls are tributary to the Chadakoin River, a Class C stream and are located
at the applicant's facility which manufactures cooling systems for trucks. A Draft Permit
has been prepared which reflects requirements for Best Available Technology and Water
Quality Standards as well as changes in the manufacturing process. Changes in the Draft
Permit include the addition of an effluent limit for Total Suspended Solids, more
stringent effluent limits for Aluminum, Fluoride, Iron, and Ammonia, and less stringent
effluent limits for Copper, Lead and Silver. Also, Hexavalent Chromium has been
eliminated from the permit's effluent limitations and monitoring requirements due to the
discontinuance of Chromium in the manufacturing process.
The

The Department has drafted
an Air State Facility Permit pursuant to Article 19 (Air
Pollution Control) of the NYS Environmental Conservation Law (ECL) and Federal
Clean Air Act Amendments and made a tentative determination to approve this
application for the L. D. McCauley facility located at 3875 California Road. L. D.
McCauley manufactures specialty automotive locking lug nuts, and fasteners for security
devices. The manufacturing operations include milling, cold forming, heat treatment,
finishing (for example, buffing and polishing), and electroplating. The manufacturing
and control equipment associated with the permitted processes are identified in the
permit. The facility is subject to the control requirements of 6 NYCRR Part 212 -
General Process Emissions, and 40 CFR 63 Subpart N - National Emission Standards for
Chromium Emissions from Hard and Decorative Chromium Electroplating and
Chromium Anodizing Tanks. The application, draft permit, relevant supporting
materials, and regulations are available for review during normal business hours at the
Region 9 Office of the NYS Department of Environmental Conservation.

The Department has drafted
a Part 373 Permit and made a tentative determination to
renew the permit for operation of CWM's facility for the treatment, storage and disposal
of hazardous and industrial non-hazardous waste on an approximately 710 acre site in the
Towns of Lewiston and Porter. The facility is located on Balmer Road about 1.9 miles
east of State Route 18. This commercial facility accepts wastes from both in-state and
out-of-state generators, as well as from generators in Canada. Wastes accepted at this
facility are ultimately either disposed of in an on-site landfill known as Residual
Management Unit-One (RMU-1), or shipped to another appropriate facility for further
processing and/or disposal. The draft permit maintains requirements for CWM to
continue corrective measures to remedy/control on-site soil and groundwater
contamination. It also maintains requirements for CWM to provide funding for
Department on-site environmental monitors, and for CWM to provide financial assurance
for closure of the facility, and for corrective measures and post-closure care in perpetuity.
In addition, the draft permit contains some additional and revised requirements related to
facility operation. The Department has scheduled an availability session on February 4,
2003 from 3:00 PM to 5:00 PM and from 7:00 PM to 9:00 PM at the Town of Porter
Town Hall, 3265 Creek Road, Youngstown, New York. The purpose of this session is
for Department staff to answer questions that the public may have on the technical,
environmental, and procedural aspects of the draft permit.
