The applicant has applied
for a renewal of an existing mining permit. The Department
intends to treat this renewal as a new application and to modify the permit for the West
Sand Lake Pit, (permit held by Lancaster Development Corporation, facility operated by
Troy Sand and Gravel Inc.). The modification is the result of: 1) continuing noise, blast
vibration, effect on water wells and dust complaints by residents of the community of
West Sand Lake which is adjacent to the mine, 2) material new information from studies
of facility operations and impacts, and 3) non-compliance with the existing SAPA
extended mining permit. Proposed modifications include: 1) added dust control
conditions, 2) requirement for quarterly hydrogeologic monitoring, 3) imposition of
restricted hours of operations, and 4) updated blasting conditions which incorporate a
revised blast design and continues to limit blasting to ten blasts per year, and no more
than two blasts per month, between March and November of each calendar year. the
mine site is located northeast of the intersection of NYS Route 43 and NYS Route 150 in
the Town of West Sand Lake, Rensselaer County. Comments on the proposed draft
modified permit will be accepted for 30 days from the date of this notice. A legislative
public comment hearing will be held on Thursday, February 6, 2003, at 7:00 p.m. at
the Algonquin Middle School, Route 66, in Averill Park. The application, draft permit,
and supporting documentation are available at the Sand Lake Library for review. All
interested parties are welcome to attend and provide verbal comments on the pending
modification and draft permit. Written comments may be mailed to the contact person
below and must be received within 30 days of the date of this notice. Comments should
include specific information relative to the draft permit or current/proposed operation of
the mine.
