The applicant proposes to
install a temporary 3 foot high weir on the north side of the
Jackson Hill Road culvert, to restore and maintain water levels on approximately 9.2
acres of Van Der Linden Pond (Freshwater Wetland No. BC-1) north of the road right-of-way. The
temporary weir may be removed after future construction of more permanent
water control features on adjacent property to the north. The project site is north of
Jackson Hill Road, approximately 4,500 feet east from NYS Route 305.

The applicant proposes to
excavate gravel and sediment from a reach of Rush Creek
approximately 175 feet long and 100 feet wide for the purpose of maintaining navigable
water depth at summer water elevation of Rushford Lake and, in addition, to excavate a
40 foot long gravel bar that is limiting navigation access to the area to be excavated. Two
to three cubic yards of excavated gravel will be used to repair an existing boat launch at
the site. The project is located on Mr. Hutton’s property, about 100 feet upstream of
County Road 49 bridge over the mouth of Rush Creek.
