PROJECT DESCRIPTION AND LOCATION: Applicant has applied for a solid waste management facility permit under Part 360 of 6 New York Codes, Rules and Regulations. The applicant proposes to operate a truck and rail recycling transfer station which will handle 156,000 tons per year (TPY) construction and demolition (C&D) material. The applicant has also agreed to replace 49,920 TPY of municipal solid waste (MSW) originally proposed to be received with an equivalent amount of pre-qualified, pre-consumer, non-recyclable, non-reusable, non-contaminated plastic coated paper, wax coated paper, paper, and low chlorine (less than 1 % dry weight as received) plastic film to be primary processed as Alternative Fuel. The proposed facility will recycle material for reuse or resale, and/or transfer unmarketable materials to a permitted solid waste disposal facility. The facility will receive material by truck only and may ship material from the facility by truck or rail. All processing will occur within an enclosed facility. No outside processing or storage is proposed. The facility is located at 7707 Henry Clay Blvd. in the Town of Clay and will use existing structures.

SEQRA STATUS AND DETERMINATION OF COMPLETENESS: The Department of Environmental Conservation made a negative declaration on August 15, 2002 at the time the application was deemed complete.

PUBLIC STATEMENT HEARING AND COMMENT PERIOD: A legislative public hearing to receive comments on the permit application for the proposed solid waste transfer station will be conducted in the Liverpool High School Auditorium , 4338 Wetzel Rd., in the Town of Clay, NY at 7:00 P.M. on Thursday January 9, 2002. Department staff will be available from 6:00 PM to 7:00 PM for informal discussion of the project. Written comments will be accepted until January 17, 2003.

All persons, organizations, corporations or government agencies which may be affected by the proposed projects are invited to attend the hearing and/or submit written comments on the proposed project. It is not necessary to file a written request in advance to participate at the legislative public hearing. Oral and/or written statements may be submitted at the hearing and will receive equal weight in the record. The order of speakers will be determined by the presiding Administrative Law Judge. Lengthy statements are required to be submitted in writing. The Judge may impose a time limit on oral statements to ensure that all persons will have an opportunity to be heard. Repetitious statements will not be allowed. The hearing site is reasonably accessible to persons with a mobility impairment. Interpreter services shall be made available to deaf persons, at no charge, upon written request to the Regional Permit Administrator named below within a reasonable time prior to the hearing.
