Project Description:
The Department has prepared
a Draft Permit and has made a tentative determination to
approve this application for modification of an existing Title V Permit. The facility is a
combined cycle gas turbine plant which produces electricity and has a nominal gross
power rating of 65 megawatts. The facility is located on the west side of Route 19A, 600
feet north of Wiscoy Creek.
This permit modification
contains applicable requirements associated with the newly
adopted "NOx Budget Trading Program", 6 NYCRR Part 204. Under Part 204 this
facility has been allocated nitrogen oxide (NOx) emissions for use during the NOx
control period, May 1st to September 30th of each year. This permit requires the facility
to track NOx emissions during the NOx control period using a certified NOx continuous
emissions monitoring system (CEMS) and to submit a compliance certification by
November 30th of each year.
This permit modification
removes the permit requirement for the turbine system to be
operated at base load. The facility submitted an emissions modeling demonstration for
operation of the turbine system at various loads below base load. The modeling
demonstration shows that no degradation of ambient air quality will occur by the system
being operated at loads lower than base load.
This facility uses both
water injection to control the creation of NOx in the turbine and
uses selective catalytic reduction (SCR) to control NOx emissions in the final exhaust
gas. Due to the use of SCR on the final exhaust, watertofuel ratio cannot be used as a
surrogate to measure NOx emissions. As a result of further review, it has been
determined that the existing system for controlling and monitoring NOx emissions is
satisfactory to demonstrate compliance with Subpart GG and therefore additional testing
is not required by this permit. The periodic monitoring conditions associated with such
additional testing have been removed from this permit.
In accordance with 6NYCRR
Parts 621.5(d)(9) and 2016.4(c), the Administrator of the
United States Environmental Protection Agency (USEPA) has the authority to bar
issuance of any Title V Facility Permit if it is determined not to be in compliance with
applicable requirements of the Clean Air Act or 6NYCRR Part 201. Persons wishing to
inspect the subject Title V files, including the application with all relevant supporting
materials, the draft permit, and all other materials available to the DEC (the "permitting
authority") that are relevant to this permitting decision should contact the DEC
representative listed below. It is recommended that an appointment be made to confirm
the availability of the subject files. The DEC will endeavor to make the files available
within 2 business days of contact, during normal business hours (8:30 am through 4:45
pm), unless the requestor wishes to inspect the files at a later date. DEC will evaluate the
application and the comments received on it to determine whether to hold a public
hearing. A public hearing may be legislative or adjudicatory. A legislative public hearing
is a proceeding which provides an additional opportunity for public comment. DEC's
determination to hold a legislative public hearing will be based on whether a significant
degree of public interest exists. If a legislative public hearing is to be held, a Notice of
Hearing will be published which will include the time and place of the hearing and
submitting comments. The applicant and all persons who have filed comments on the
permit will be notified by mail of the public hearing.Comments and requests for a
legislative public hearing should be in writing and addressed to the Department
representative listed below. An adjudicatory public hearing is a trial type proceeding
which provides the opportunity for adjudication on the basis of evidence, including direct
testimony and cross examination. An adjudicatory hearing is held only if substantive and
significant issues relating to any findings or determinations the Department is required to
make pursuant to the Environmental Conservation Law exist. A copy of the Department's

Project Description:
The Department has prepared
a draft permit and fact sheet and made a tentative
determination to modify the current SPDES Permit, # NY- 0020826, for the treated
discharge of municipal wastewater from the North Chautauqua Lake Sewer District
Wastewater Treatment Facility, located at 1 Clark Street, Mayville NY. This tentative
determination indicates that the discharge regulated under this statute is considered to
satisfy regulatory standards for permit issuance, based on information available to the
Department at this time. As a tentative determination, the Department seeks comments
on the proposed regulated activity prior to making a final decision on permit issuance.
The modifications proposed by the applicant include upgrading the treatment system to
replace gas chlorination with ultraviolet light disinfection, providing phosphorus removal,
and increasing the overall treatment capacity from 0.5 to 0.75 MGD. Discharge
notification act maintenance requirements have been included in the permit. Interim
effluent limits will apply until the upgrade construction is complete, then final limits take
effect. The plant discharges to Chautauqua Lake (class A waters) via outfall 001, and, at
times, to Mud Creek (class C waters) via outfall 002 & 003.
The draft permit, fact sheet,
application, and applicable regulations are available for
inspection at the NYSDEC Region 9 Office. Comments in support of or in opposition to
the proposed permit may be made by filing a written statement by the response date
indicated.
