Project Description:
The Department has made
a tentative decision to approve this application for
modification of the applicant’s existing Title V Facility Permit. The modification is being
proposed by the applicant for the purpose of establishing certified emission reduction
credits (ERC) for the past reductions which were the result of shutdown of three engines
at the Oceanside Landfill in January 1, 2002.
The engines utilized collected
landfill gas to generate electricity.
With this permit modification
the applicant will be establishing emission reduction
credits for 15.86 tons per year NOX in accordance with 6 NYCRR Part 231, “New Source
Review in Nonattainment Areas.” The facility has also applied for 21.14 tons per year
CO credit. The United States Environmental Protection Agency has designated the NYC
area as in attainment of the national ambient air quality standard for CO. As a result
DEC has removed the metropolitan carbon monoxide nonattainment area (NYC) from the
definition of nonattainment areas in 6NYCRR Part 200.1. ERCs are emission reductions
of nonattainment contaminants. As CO is no longer considered a nonattainment
contaminant in NYS DEC will no longer be certifying CO ERCs. The application and
supporting documentation are available for review at the Region 1 office.
Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. It is recommended that an appointment be made to confirm the availability of the subject files. The DEC will endeavor to make the files available within 2 business days of contact, during normal business hours (8:30 am through 4:45 pm), unless the requestor wishes to inspect the files at a later date. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. A public hearing may be legislative or adjudicatory. A legislative public hearing is a proceeding which provides an additional opportunity for public comment. DEC's determination to hold a legislative public hearing will be based on whether a significant degree of public interest exists. If a legislative public hearing is to be held, a Notice of Hearing will be published which will include the time and place of the hearing and submitting comments. The applicant and all persons who have filed comments on the permit will be notified by mail of the public hearing. Comments and requests for a legislative public hearing should be in writing and addressed to the Department representative listed below. The applicant has requested to: change the lower limit of the pH range to 5.5 SU at all
three outfalls; eliminate effluent limit and monitoring requirement for 1,1,1-
Trichloroethane at Outfall 001; eliminate effluent limits and monitoring requirements for
1,1- Dichloroethane and 1,1,1-Trichloroethane at Outfall 002; eliminate effluent limit and
monitoring requirement for Trimethylbenzene at Outfall 003; add effluent limit and

determination to issue a modification for a State Pollutant Discharge Elimination System
permit under Article 17 of the Environmental Conservation Law. This tentative
