expand an existing Wal-Mart, from 121,016 square feet to
203,531 square feet, to add garden and food centers. The proposal includes filling
approximately 0.25 acre of federally regulated wetland. As compensatory mitigation, a
0.74 acre wetland will be constructed on-site. The project site is located at 350
Fairmount Avenue (NYS Route 394) in the Village of Lakewood.

Project Description:
The applicant proposes a
modification of an existing discharge of 600 gallons of
untreated sanitary and oil/water separator effluent wastewater to groundwater and an
unprotected tributary of Buffalo Creek at the applicant's facility located at 2699 Transit
Road, Elma. The applicant operates an office and shop. The Department has made a
tentative determination to issue a permit for a State Pollutant Discharge Elimination
System permit under Article 17 of the Environmental Conservation Law. This tentative
determination indicates that the discharge regulated under this statute is considered to
satisfy regulatory standards for permit issuance, based on information available to the
Department at this time. As a tentative determination, the Department seeks comments on
the proposed regulated activity prior to making a final decision on permit issuance. As
such, this tentative determination does not signify Department approval for or
endorsement of the activity for which a permit is sought or for the overall proposed

Project Description:
The applicant proposes to
perform work in Gill Creek, a Class C Stream, to repair a
portion of the concrete lined channel section, which has subsided near where it passes
over the underground conduits of the New York Power Authority's Robert Moses Power
Plant. The proposed repair consists of replacement of 22 linear feet of concrete channel
liner and the new installation of 123 linear feet of medium size rock riprap, placed over
geotextile liner within the existing channel. The project is located at the upstream end of
an existing 690 foot long open concrete lined channel in the Hyde Park Golf Course,
approximately 1800 feet North of Porter Road.
