Project Description:
The Department of Environmental
Conservation (DEC) has made a tentative
determination to approve this application for a new State Pollutant Discharge Elimination
System (P/C/I SPDES permit) for expansion of the Inn facility. The existing Inn has a
General Permit (GP-95-01) for a subsurface sanitary waste discharge design flow of
1,850 gpd. A proposed 12,000 sq. ft. catering facility and additional 20 motel units will
require two new outfalls and an increase in the total design flow to up to 10,112 gpd to
groundwaters. The proposed permit includes effluent limitations and monitoring and
reporting requirements, and would be issued for a five-year period. A draft permit is
available for inspection and comment at the Region 3 office.

Project Description:
The applicant proposes to
construct a driveway across Freshwater Wetland NB-22 (Class
II) and the adjacent 100 feet for the purpose of providing access to a proposed single
family dwelling. The proposed driveway crosses approximately 275 linear feet of
wetland and 550 feet within the wetland adjacent area. As mitigation for the driveway
construction, the application proposes to remove approximately 1,400 cubic yards of fill
which was previously deposited in the wetland by a prior owner, thereby restoring
approximately 15,000 square feet of wetland. The project site consists of 10.8 acres
located immediately north of Gardnertown Road and approximately 1000 feet east of
Lakeside Road in the Orange Lake section of the Town of Newburgh.

Project Description:
The
applicant proposes to disturb 0.45 acres of 1.45 acre federally regulated wetland
in order to construct “The River Club” consisting of between 418 to 440 affordable
residential housing units in a 7 to 10 story building complex. It would be located on a 4.6
acre property on the west side of Warburton Avenue, north of Odell Avenue, in the City
of Yonkers. The federal wetland is at the lowest elevation on the western portion of the
property, adjacent to the Metro North Hudson River Line and Amtrak railroad tracks.
The applicant has also applied to the U.S. Army Corps Of Engineers for a permit under
Section 404 of the federal Clean Water Act for filling this 0.45 acres of federally
regulated wetland. The River Club proposes to mitigate the loss of federal wetland by the
creation of a one-acre wetland preserve in Tibbetts Brook Park, a Westchester County
facility elsewhere in the City of Yonkers, resulting in a 2 for 1 replacement of wetlands
lost at The River Club site. The applicant is seeking this Section 401 Water Quality
Certification from the New York State Department of Environmental Conservation
because the project requires a federal wetland permit from the U.S. Army Corps of
Engineers.
