Project Description:
The applicant proposes the
mining of sand and gravel, with material processing by a
portable dry-screen that has a maximum capacity of less than 150 tons per hour, on 11.16
acres of land. With the agreement of two adjacent landowners, a variance from the 25-foot minimum
property line set-back is proposed for those common property lines. The
estimated life of the mine is 10 years and the reclamation objective is a meadow, with no
future use planned. The proposed mine is located on a property that has been the site of
past mining and is south of Chautauqua County Route 380, approximately 800 feet north-west from its intersection with County Route 55.

Project Description:
The applicant proposes the
mining of gravel and sand, with material processing by a 110
tons per hour portable dry screen, on 37.36 acres of land. A portable crusher will
occasionally be rented to process accumulated oversize stone. The estimated life of the
mine is 20 years and the reclamation objective is a Christmas Tree Farm. The site is
1,250 feet west of Hoag Road and approximately 1,800 feet south of Waltonian Drive.
The proposed mine haul road is an existing natural gas well access that provides access to
Hoag Road.

Project Description:
It is proposed to modify SPDES Permit No. NY-024
3108 which has an existing
discharge of 26,000 gallons per day (GPD) of sanitary wastewater, boiler blowdown,
softener backwash and purified water cleaning from Outfall 001, and 26,000 GPD of
treated process wastewater from Outfall 002, both of which discharge to an un-named
tributary to Big Six Mile Creek, at the applicant's facility located at 3125 Staley Road.
The draft permit contains changed monitoring requirements for Fecal Coliform and
increased effluent limits for Zinc and Iron.
The
Department has made a tentative determination to issue a permit for a State
Pollutant Discharge Elimination System permit under Article 17 of the Environmental
Conservation law. This tentative determination indicates that the discharge regulated
under this statute is considered to satisfy regulatory standards for permit issuance, based
on information available to the Department at this time. As a tentative determination, the
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. As such, this tentative determination does not signify
department approval for or endorsement of the activity for which a permit is sought or for
the overall proposed project.

Project Description:
The Department has prepared
a draft permit and fact sheets and made a tentative
determination to modify the current SPDES Permit, # NY- 0001601, for discharges of
non-contact cooling water, average flow of 3.5 MGD at outfall #001, and for intake
screen backwash water at outfall #002 from the E.I. duPonte Yerkes manufacturing
facility, located at Sheridan Dr. at River Rd., Tonawanda NY. This tentative
determination indicates that the discharge regulated under this statute is considered to
satisfy regulatory standards for permit issuance, based on information available to the
Department at this time. As a tentative determination, the Department seeks comments
on the proposed regulated activity prior to making a final decision on permit issuance The
draft permit was developed in accordance with the Department’s Environmental Benefit
Permit Strategy (EBPS) and uses information supplied by the Permittee. The EBPS score
for this modification is 491 points.
The proposed modifications
include: adding Discharge Notification Act requirements,
listing and requiring monitoring of new outfall #002 for the discharge of intake screen
backwash water, and increasing the chlorine residual discharge limit from 0.5 mg/l to 1.0
mg/l during Zebra Mussel treatment. The Yerkes plant manufactures Corian(R) building
products, Tedlar(R) polyvinyl fluoride film, and a vinyl fluoride polymer. Outfalls from
the plant are located approximately 900 feet upsteam of the foot of Sheridan Drive and
discharge into the Niagara River ( class A special waters).
The draft permit, fact sheet,
application, and applicable regulations are available for
inspection at the NYSDEC Region 9 Office. Comments in support of or in opposition to
the proposed permit may be made by filing a written statement by the deadline date
indicated.
