Project Description:
The Department has made
a tentative determination to issue a permit modification for a
State Pollutant Discharge Elimination System permit under Article 17 of the
Environmental Conservation law. The applicant proposes to modify an existing discharge
of approximately .41 million gallons per day of process wastewater, cooling water and
stormwater (Outfall 013) to the Seneca River/Barge Canal from the Evans Chemetics
facility owned by Hampshire Chemical located at 228 East Main Street, Waterloo, NY.
The facility, which manufactures sulfur-based chemicals, has constructed and begun
operating a new wastewater treatment plant. The proposed change includes extending the
interim limit for iron of 1.5 mg/l as the final limit rather than the more stringent effluent
limit of .55 mg/l due to high background concentrations of iron in the influent water. This
modification requires a variance from 6NYCRR Part 702.17. In addition, the Department
proposes to change the Total Suspended Solids limit of 114 pounds/day to 176
pounds/day based on a review of the categorical limits in 40 CFR Part 414.81. This
tentative determination for the SPDES permit modification indicates that the discharge
regulated under this statute is considered to satisfy regulatory standards for permit
issuance. A Negative Declaration is on file. As a tentative determination, the Department
seeks comments on the proposed regulated activity prior to making a final decision on

Project Description:
The applicant proposes to
expand a 16-acre gravel mine on a +/- 64-acre parcel to a total
of approximately 25 acres. The mine site is located south ot State Route 226,
approximately 1500 feet west of the Schuyler County/Steuben County border. The
mining operation is typical unconsolidated surface extraction of gravel. Excavation is
done by mechanical equipment, standard for gravel mining operations. A portable crusher
and screener will be used to process the gravel and cobble material, with no water
required for this operation. There will be no mining below the local water table. Mining is
proposed to remove approximately 75,000 cubic yards of gravel over the operational life
of the mine. The material will be used by both municipal and commercial clients.

Project Description:
The Erwin has submitted
a water supply application for the purpose of providing public
water to lands under development for the Corning Inc diesel filter manufacturing plant on
the north side of State Route 417 near Erwins NY, and to undeveloped lands south of
Route 417 and north of the Canisteo River. A total of 128 acres can be served and the
permit when issued allocates 251,000 gallons of water per day to the service area.

Project Description:
The Department has made

of approximately 490 million gallons per day of circulating cooling wastewater (Outfall
001) to Lake Ontario from the Rochester Gas and Electric Corporation Ginna Nuclear
Power Plant - Station 13 facility, located at 1503 Lake Road, Ontario, NY. The proposed
change includes revising the effluent discharge for Boron from 40 pounds per day to 140
pounds per day. The revised limit, which is under the Water Quality Guidance Value, will
allow operational flexibility. This tentative determination for the SPDES permit
modification indicates that the discharge regulated under this statute is considered to
satisfy regulatory standards for permit issuance. As a tentative determination, the
Department seeks comments on the proposed regulated activity prior to making a final
