Pursuant to the Environmental Conservation Law, Sections 3-0301, 11-0325 and 11-1905, the Department of Environmental Conservation hereby gives notice of the following:

Adoption of emergency regulations 6NYCRR Part 189 relating to Chronic Wasting Disease. The adoption notice will be published in issue 44 of the State Register, dated 10/30/2002. This regulation was effective upon filing on 10/11/2002.

ADOPTION OF AMENDMENTS TO AIR REGULATIONS

Pursuant to Environmental Conservation Law, Sections 1-0101; 3-0301; 3-0303; 19-0103; 19-0105; 19-0107; 19-0301; 19-0302; 19-0303; 19-0305 and 19-0306, the NYS Department of Environmental Conservation gives notice of the following:

NOTICE OF ADOPTION OF RULE on September 18, 2002, to be effective October 18, 2002: amendments to 6 NYCRR Part 200, General Provisions, and Part 219, Incineration, Subparts 219-1 Incineration-General Provisions, and the addition of new Subpart 219-8, Emission Guidelines and Compliance Times for Small Municipal Waste Combustion Units Constructed on or before August 30,1999.

The purpose of this rulemaking is to implement and enforce the requirements of the federal Emission Guidelines (40 CFR 60, Subpart BBBB) for small Municipal Waste Combustors (MWCs). New York is mandated by the CAAA of 1990 to submit to EPA a State Plan to implement and enforce the Emission Guidelines requirements.

ADOPTION OF AMENDMENTS TO AIR REGULATIONS

Pursuant to Environmental Conservation Law, Sections 1-0101, 3-0301, 19-0103, 19-0105, 19-0301 and 19-0305, the New York State Department of Environmental Conservation gives notice of the following:

NOTICE OF ADOPTION OF RULE on October 10, 2002, to be effective November 9, 2002: amendments to 6 NYCRR Part 200, General Provisions, and new Part 239, Portable Fuel Container Spillage Control.

This rule will reduce VOC emissions when refueling using gas cans (portable containers) and when transporting and storing fuel in portable containers.

Pursuant to Environmental Conservation Law, Sections 1-0101; 3-0301; 19-0103; 19-0105; 19-0301; 19-0303; 19-0305 and 19-0306, the NYS Department of Environmental Conservation gives notice of the following:

NOTICE OF ADOPTION OF RULE on September 30, 2002, to be effective October 30, 2002: amendments to 6 NYCRR Subpart 219-1, Incineration-General Provisions, and Subpart 219-2, Municipal and Private Solid Waste Incineration Facilities; and new Subpart 219-7, Mercury Emission Limitations for Large Municipal Waste Combustors Constructed on or before September 20, 1994.

A more stringent emission limit for mercury from large municipal waste combustors than is currently contained in federal regulation has been adopted to reduce mercury emissions and subsequent environmental loading of mercury in New York State and the Northeast.
