Project Description:
The applicant has applied
to permit the existing discharge of up to 16,250 gallons per day
of sanitary wastewater to groundwater after treatment by three (3) septic tank/absorption
field treatment systems and 200 gallons per day of wastewater from floor drains in the
maintenance area and bus storage and wash areas to a storm sewer tributary to Olean
Creek after treatment by two (2) oil/water separators, at the applicant's facility at 3701
Main Street, Hinsdale. The Department has made a tentative determination to issue a
permit for a State Pollutant Discharge Elimination System Permit under Article 17 of the
Environmental Conservation Law. This tentative determination indicates that the
discharge regulated under this statute is considered to satisfy regulatory standards for
permit issuance, based on information available to the Department at this time. As a
tentative determination, the Department seeks comments on the regulated activity prior to
making a final decision on permit issuance. As such, this tentative determination does not
signify Department approval for or endorsement of the activity for which a permit is

Project Description:
The Department has prepared
a draft SPDES permit, No. NY- 0259179, fact sheets and
made a tentative determination to issue an initial five year approval for the treated
discharge of treated drinking water from the Chautauqua Utility District’s Water
Treatment Plant, located on the grounds of the Chautauqua Institute, Town of
Chautauqua, NY. This tentative determination indicates that the discharge regulated
under this statute is considered to satisfy regulatory standards for permit issuance, based
on information available to the Department at this time. As a tentative determination, the
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. The draft permit was developed in accordance with the
Department’s Technical & Operational Guidance Series (TOGS 1.3.3.) and uses
information supplied by the applicant.
The proposed permit includes
monitoring requirements and effluent limits for a design
discharge flow of 0.062 MGD resulting from an approximately 30 minute discharge of
filtered water following immediately after backwashing filters to a holding tank. The
Discharge is to an unnamed tributary, Class C waters, of Chautauqua Lake. Proposed
discharge notification act requirements may require a sign identifying the outfall within
the Institute grounds.
The applicant has requested
a Water Supply Permit, WSA # 10,356, reflecting the
following: 1) the previous transfer of water facilities ownership from Chautauqua
Institution to Chautauqua Utility District; 2) inclusion of the 1991 “Highlands” and 2000
“Woodlands” service area expansions and water main extensions, and; 3) Water
Treatment Plant Improvements within the existing building which will increase supply
capacity from 0.75 MGD to 1.5 MGD and comply with 1996 amendments to the Federal
Safe Drinking Water Act.
The draft permits, fact
sheets, applications, and applicable regulations are available for
inspection at the NYSDEC Region 9 Office. Comments in support of or in opposition to
the proposed permits may be made by filing a written statement by the deadline date
indicated.

Project Description:
The Department has prepared
a draft permit pursuant to Article 19 (Air Pollution Control)
of the NYS Environmental Conservation Law and made a tentative decision to approve
an application for an Air State Facility Permit for Monofrax, Inc. located in the Town of
Ellicott, Chautauqua County. Monofrax is a ceramic foundry that manufactures fused cast
refractories with materials being blended, melted in four electric arc furnaces and cast
into molds. This permit will allow the facility to cap out of Title V Permit applicability,
Part 201-6.1(a). Facility-wide particulate and oxides of nitrogen (NOX) emissions will be
limited to less than 80 tons per twelve-month period. The Draft Permit, with conditions,
application, relevant supporting materials and regulations are available during normal
business hours at the DEC office provided in the notice. Comments of support or
objection may be made by filing a written statement by the deadline date indicated.

Project Description:
The applicant proposes to
add 34.3 acres to the currently permitted 45.7 acre Maloy Farm
Gravel Mine, on the property of Leon and Virginia Maloy, and located west of NYS
Route 60 and south of Chautauqua County Route 62 and Mill Creek. The plan includes
relocation of an abandoned AT&T Right-of-Way segment, and relocation of Tributary #2
(Cold Brook) of Mill Creek, an intermittent stream, around the new mine area to
perpetuate its flow into Freshwater Wetland #EC-2 by connecting it into Crooked Brook.
It is proposed to continue mining below the ground water table, which will increase the
size of the excavated pond to 61.7 acres surrounded by 12.8 acres of shoreline. The
remainder of the expansion area is to be reclaimed to 1 acre of wetland and 4 acres of
agricultural land. The main haul-way will remain and will occupy 0.5 acres. No other
changes in mine operating procedures nor the reclamation plan for the currently permitted
area, are proposed. It is also proposed to armor approximately 700 linear feet of Mill
Creek (a Protection of Waters permit application to be applied for at a later date, after
preparation of plans and specifications) to compensate for mining 17.4 acres of farm land
by providing erosion protection for valuable farm land.
The NYS Department of Environmental
Conservation, as SEQR Lead Agency, has
accepted a Draft Supplemental Environmental Impact Statement (DSEIS) for this
proposal. The complete application and DSEIS are available for review at the
Department's Allegany Office (address below). In addition, the DSEIS, which includes
the pending permit application and proposed Mined Land-Use Plan, is available for
public review at the Department's office at 215 South Work Street, Falconer, NY; the
Gerry Town Hall, 4519 Route 60, Gerry NY and the Sinclairville Free Library, 15 Main
Street Sinclairville NY.
