Project Description:
Berrians 1 Gas Turbine Power, LLC proposes to install and operate a new gas turbine electric generator to produce peaking power at a maximum output of 79.9 megawatts at all times. The unit will consist of a single General Electric Frame 7 EA combustion turbine, fired by natural gas or distillate fuel oil.  The turbine will operate as a simple cycle unit.  Barrians has applied for an air pollution control permit pursuant to Article 19 of the Environmental Conservation Law (ECL) and Part 201 of Title 6 of the New York Compilation of Codes, Rules and Regulations (6NYCRR), and a Title IV - Phase II Acid Rain permit.  Potential air emissions have been modeled in accordance with DEC modeling guidance, and reviewed by the Department's Division of Air.  The project site is the existing Astoria Gas Turbine Power, LLC facility.  Construction will affect a ± 2.5 acre portion of the Astoria power complex.

Pursuant to 6NYCRR Part 201, the Applicant has opted to obtain a State Facility preconstruction  permit and certificate to operate authorizing the construction and operation of the Kings Park Energy facility prior to obtaining a Title V permit.

Pursuant to the Phase II requirements of Title IV of the Clean Air Act and 40 CFR §72.6(a)(3), DEC staff have also reviewed the Applicant's Acid Rain permit application included in the Air State Facility application, and has found it approvable.

The Department has made a tentative decision to approve these permit applications. Application materials and the draft permits are available for review during normal business hours at the DEC Central Office in Albany (address and contact below), at the DEC Region 2 Headquarters in Long Island City, and at the Astoria Branch and the Steinway Branch of the Queens Public Library. State Environmental Quality Review (SEQR) Determination: Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.
SEQR Lead Agency: NYC Dept of Environmental Protection
State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management: This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment: Comments on this project must be submitted in writing to the Contact Person no later than Nov 15 2002.
