Project Description: The New York State Department of Environmental Conservation (NYSDEC) has received a request to modify the permit to operate air contamination sources for Bristol Myers Squibb Company Inc., 6000 Thompson Road, Syracuse, NY 132214755. This modification, for the construction/installation of new boiler #10, is being purposed by Bristol Myers Squibb Company Inc., for the purpose of restricting the potential to emit specific criteria pollutants including: nitrogen oxides (NOx), sulfur dioxide (SOx) and volatile organic compounds (VOC) from these emission sources, through (state and federally) enforceable permit conditions and limits which will "cap" emissions at a level which is below the applicability threshold(s) as specified in one or more of the following regulations: 40 CFR 52 Subpart A. Any facility meeting the requirements to "capout" of 40 CFR 52 Subpart A, will be subject to all other applicable requirements of 6 NYCRR and 40 CFR 52, Subchapter A. The applicant has agreed to permit conditions
which will limit emissions of nitrogen oxides, sulfur
dioxides and volatile organic compounds, through restrictions on one or more of the following:
quantity of VOC containing compounds utilized, production throughput (quantity), and hours of
operation (daily, weekly, monthly or annually). The permittees will be required to maintain
records, and report this data to verify compliance with permit conditions and limits.
Persons wishing to inspect the subject files,
including the application with all relevant supporting
materials, the draft permit, and all other materials available to the DEC (the "permitting authority")
that are relevant to this permitting decision should contact the DEC representative listed below. It
is recommended that an appointment be made to confirm the availability of the subject files. The
DEC will endeavor to make the files available within 2 business days of contact, during normal
business hours (8:30 am through 4:45 pm), unless the requestor wishes to inspect the files at a
later date.
DEC will evaluate
the application and the comments received on it to determine whether to hold
a public hearing. A public hearing may be legislative or adjudicatory. A legislative public hearing
is
a proceeding which provides an additional opportunity for public comment. DEC's determination to
hold a legislative public hearing will be based on whether a significant degree of public interest
exists. If a legislative public hearing is to be held, a Notice of Hearing will be published which will
include the time and place of the hearing and submitting comments. The applicant and all persons
who have filed comments on the permit will be notified by mail of the public hearing. Comments
and requests for a legislative hearing should be in writing and addressed to the Department
representative listed below.
An
adjudicatory public hearing is a trial type proceeding which provides the opportunity for
adjudication on the basis of evidence, including direct testimony and cross examination. An
adjudicatory hearing is held only if substantive and significant issues relating to any findings or
determinations the Department is required to make pursuant to the Environmental Conservation

Project Description: The Department has drafted
an Air State Facility permit modification pursuant to Article
19, Air Pollution Control, of the NYS Environmental Conservation Law and Title V of
the Federal Clean Air Act Amendments, and has made a tentative determination to
approve the application for an existing facility, Barrett PavingMaterials, Inc., located at
Huntley Road, Phoenix, NY 13135. The facility produces asphaltic concrete and the
permit modification would allow the ho tmix asphalt plant burner to use both fuel oil and
natural gas. The emissions produced by the facility will continue to be capped below 100
tons. The application and draft permit are available for review at the Region 7 Syracuse
Office. Written public comments on the draft permit must be postmarked within 30 days
