Project Description:
The applicant proposes to remove a gravel bar to within 6 inches of the waterline and rip-rap 175 feet of eroded stream bank on Fulmer Creek, a class C, standards C(T) stream. Herkimer County Soil and Water Conservation Service has provided technical drawings for the project. The site is located at 3403 Route 168, Town of German Flatts, Herkimer County.
State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.
SEQR Lead Agency: NYS Department of Environmental Conservation
State Historic Preservation Act (SHPA) Determination: Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:
The New York State Department of Environmental Conservation (DEC) has made a tentative determination to approve these applications to construct and operate a yard waste composting facility in the Town of New Hartford. The applicant has applied for a Article 27, Title 7, Part 360 Solid Waste Management permit to construct and operate the composting facility. The facility will handle green waste, leaves, grass, garden waste, and brush from the residents of the Town of New Hartford. The applicant has also submitted a State Pollutant Discharge Elimination System (SPDES) application for the discharge of treated stormwater runoff.  The permittee has proposed a two basin constructed wetland treatment system to treat and infiltrate runoff up to the 25 year storm event.  Runoff in excess of the 25 year storm will be discharged to the Sauquoit Creek via Outfall 001. Sauquoit Creek is a Class C stream with standards C(t). Draft permits are available for review at the Utica DEC office, 207 Genesee Street, Utica, New York. The applicant proposes to construct a 16" x 24" addition to his existing residence within the regulated 100 foot adjacent area of Freshwater Wetland J-4. The addition will be 54 feet from the wetland boundary. Additionally the applicant proposes to move an existing storage shed to within 40 feet of the wetland boundary. The site is located on the east side of  Mill Road approximately 800 feet south of Barn Road.,  in the Town of Vienna, Oneida County.
