Erie County - The Town Board of the Town of Amherst, as lead agency, has determined that the proposed Muir Woods Multi-Use Development may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. A Public Scoping Session will be held on Thursday, August 8, 2002 at 7:00 p.m. to 9:00 p.m. at the Town of Amherst Council Chambers, 5583 Main Street, Williamsville, New York. The action involves a proposed amendment to the Audubon Development Plan to reclassify 326 acres of land from New Community District - Neighborhood District and Major Open Space to New Community District - General Commercial, Restricted Industrial and Major Open Space for the development of a multi-use development to include a 60 lot single-family residential subdivision, a 50-unit townhome project, a 60 unit apartment development, and a 1.76 million sq. ft. commercial/office/research and development/retail complex. The project is located at 1081 and 1121 North French Road, Town of Amherst.

On July 14, 2000, the Federal Energy Regulatory Commission issued a final Rule (Order 616) in Docket No. RM00-6-000 reinstating wellhead determination procedures under the Natural Gas Policy Act of 1978. Order No. 616 reinstates the procedures for Section 107 wellhead gas that qualifies for a tax credit under Section 29 of the Internal Revenue Code.

In accordance with an agreement between the New York State Department of Environmental Conservation and the Federal Energy Regulatory Commission: under the authority of §§3-0301(1)(w), 3-0301(2)(d) and 3-0301(2)(j) of the New York State Environmental Law and Sections 503(c) and described in 503(a) of the Natural Gas Policy Act of 1978 (P.L. 95-621); notice is hereby given that the following operators have filed a complete application seeking a determination for tight formation gas under NGPA Section 107 to be eligible for a tax credit under Section 29 of the Internal Revenue Code for the gas produced from the indicated well. Chautauqua County - The Town of Chautauqua, as lead agency, has determined that the proposed Chautauqua Erie Development Corp. will not have a significant adverse environmental impact. The action involves construction of four multiple family dwellings with four units each, one office building with two additional residential units, a swimming pool and parking areas. The project is located at 4793 West Lake Road, Mayville, New York, Town of Chautauqua.
