Project Description: The applicant proposes a
6.5 acre addition to the current 15.04 acre Birch Run Gravel Pit,
excavating 26 to 40 feet deeper throughout the mine floor, and a new primary haul road
350 feet west of the existing haul road. The reclamation objective will remain the same -
tree and shrub plantings for wildlife habitat. The mine is located on the south side of
Lower Birch Run Road, 200 feet east of Snell Road. The expansion area is adjacent to
the existing south and west mine limits.

Project Description: The application is for a
Wetlands Reserve Program Wetland Restoration Project
consisting of the construction of a 2.5 foot high by 325 feet long earthen embankment to
plug former agricultural drainage ditches, and the excavation of several level ditches. The
purpose of the project is to establish up to 8 acres of shallow open water for water fowl.
The project site is south of Ischua Creek, within regulated Freshwater Wetland No. WV-3 and within
the flood pool area of Ischua Watershed Flood Control Dam Site #1,
approximately 700 feet west of the dam.

Project Description: As part of the construction
of a one acre pond, the applicant proposes to place rock riprap
along 110 lineal feet of the streambank of Gears Gulf, which is a Class B protected
tributary of the East Branch Cazenovia Creek and place earthen fill for the pond
embankment along that stream reach. The toe of the embankment fill will be kept back
approximately 10 feet from the normal high water mark of the stream. The project is
located on the north side of Holland Glenwood Road approximately 1300 feet east of
Phillips Road.

Project Description: The Department has prepared
a draft permit and made a tentative determination to
approve an application for the modification of the existing SPDES permit for the
discharge of 0.278 million gallons per day (30 day mean) to Lake Ontario of treated
sanitary wastewater treated from the Somerset-Barker Sewage Treatment Plant. The
modification would allow a reduction in percent removal requirements for biochemical
oxygen demand and total suspended solids from 85% to 80%. The facility is located at
8500 Lower Lake Road, just west of Quaker Road, in the Town of Somerset. The
application, supporting documentation and draft permit are available for review at the
Buffalo Regional office during business hours.

Project Description: The Department has prepared
a draft permit and fact sheet and made a tentative
determination to modify the current SPDES Permit, # NY- 0026948, for the treated
discharge of municipal wastewater from the Village of Arcade Wastewater Treatment
Facility, located on Hurdville Road, Arcade, NY. This tentative determination indicates
that the discharge regulated under this statute is considered to satisfy regulatory standards
for permit issuance, based on information available to the Department at this time. As a
tentative determination, the Department seeks comments on the proposed regulated
activity prior to making a final decision on permit issuance. The draft permit was
developed in accordance with the Department’s Environmental Benefit Permit Strategy
(EBPS) and uses information supplied by the Village. The EBPS score for this
modification is 65 points.
The proposed modification
will update monitoring requirements per the Department’s
Technical & Operational Guidance Series (TOGS 1.3.3.). Changes include the addition
of effluent limits and monitoring for copper, ammonia, dissolved oxygen and phenols
while deleting testing for cyanide and zinc. An abatement schedule has been proposed
for reducing chlorine residuals in the discharge. Also, a pretreatment mini schedule
providing for a Fast Report On Significant Industries (FROSI) is included as well as a
discharge notification act maintenance requirement. The plant provides secondary
treatment via contact stabilization and chlorination for a design flow of 0.5 MGD and
discharges to Cattaraugus Creek, a class C(T) stream.
The draft permit, fact sheet,
application, and applicable regulations are available for
inspection at the NYSDEC Region 9 Office. Comments in support of or in opposition to
the proposed permit may be made by filing a written statement by the deadline date
indicated.
