Project Description:
The Department has made a tentative determination to approve an application for an Air State Facility Permit from Barrett Paving Materials, Inc. at their asphalt plant located on Old Vestal Road, Vestal, NY.    The facility consists of one asphalt plant and associated control equipment in the manufacturing of asphaltic concrete.  The facility consists of one hot mix asphalt plant and associated control equipment used in the manufacturing of asphaltic concrete.  The hot mix facility includes one 5 ton batch plant.  The batch plant has one process source (dryer) and one primary control.

Barrett has requested federally enforceable permit conditions that will limit (cap) the facility's potential to emit Carbon Monoxide (CO) to less than 100 tons per year.  This will be accomplished by limiting the production of asphalt to 580,000 tons per year, on a 12-month rolling average basis.  By accepting the state and federally enforceable emission limits and conditions, Barrett Paving will not be subject to Title V (40CFR60) of the Clean Air Act Amendments of 1990.  The facility will be subject to all other applicable requirements of 6 NYCRR Subchapter A.  The permittee will be required to maintain records and report this data to verify compliance with permit conditions and limits.

The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.
State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The applicant proposes to construct a dam at a location where a beaver dam has historically been located.  The dam will impound approximately 17 acres of water, much of which is classified as a regulated freshwater wetland by DEC.  Water elevations will not exceed thos historically maintained by the beavers.    The project is located in regulated freshwater wetland OX-8, also known as Tank Pond, approximately 3.5 miles east of Oxford, off Old Virginia Road, in the Town of Oxford, Chenango County.
State Environmental Quality Review (SEQR) Determination: Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.
