Project Description: Applicant proposes to modify
an existing SPDES permit to increase the flow from 900
gpd to 2500 gpd and decrease the quality (5 mg/1BOD to 10 mg/1BOD) of treated
sanitary waste to an intermittent storm drain tributary to the Wyomanock Creek due to
proposed plant expansion.
The Department has made
a tentative determination to modify this permit for a State
Pollutant Discharge Elimination System Permit under Article 17 of the Environmental
Conservation Law. This tentative determination indicates that the discharge regulated
under this statute is considered to satisfy regulatory standards for permit issuance, based
on information available to the Department at this time. As a tentative determination, the
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. As such, this tentative determination does not signify
Department approval for or endorsement of the activity for which a permit is sought or
for the overall proposed project.

Project Description: The applicant proposes to
construct a 630' long X 20' wide driveway, of which 240 feet
will be in Freshwater Wetland SY-8 and the remainder in its adjacent area. The driveway
location will be cleared of brush and constructed with shale and/or gravel, and a culvert
will be installed in Wharton Creek which runs through the wetland. The driveway will
provide access to property in order to facilitate building a single family residence, part of
which will be in the wetland adjacent area, and provide pasture for agricultural use. The
project is located on Buell Road just north of the Plainfield/Richfield/Exeter town line.
