Project Description: The Department has
received an Air State Facility (ASF) permit application from Altx, Inc.,
located on Lincoln Avenue in the Town of Colonie, Albany County to cap the facility out of
Title V (Part 201-6). The facility is an alloy steel extrusion plant. This cap will also
cap the
facility out of NOx Reasonably Available Control Technology (RACT) (Part 227-2) and Part 212
RACT (Part 212.10).
The applicant has
proposed to accept a cap on emissions of carbon monoxide (CO), sulfur
dioxide (SO2), particulate matter less than 10 microns (PM10), oxides of nitrogen (NOX),
volatile organic compounds (VOC), and total and individual hazardous air pollutants (HAP)
which will restrict the potential to emit of the facility to a level which is less than the
applicability threshold for Title V. These levels are: 100 tons per year for CO, SO2, PM10, and
NOX; 50 tons per year for VOC; and 25 tons per year for total HAP and 10 tons per year for
each individual HAP. By accepting these state and federally enforceable limits, Altx, Inc. will
not be subject to these regulations.
The applicant has
agreed to permit conditions which will limit emissions of the above
contaminants to less than the above thresholds. Emissions are limited by limiting the volume of
steel pickled and the volume of fuel fired. The permittee will be required to maintain records and
to report this data to verify compliance with permit conditions and limits.
Persons wishing to
inspect the subject ASF files, including the application with all relevant
supporting materials, the draft permit, and all other materials available to the DEC (the
“permitting authority”) that are relevant to this permitting decision should contact the DEC
representative below. It is recommended that an appointment be made to confirm the
availability of the subject files. The DEC will endeavor to make the files available within 2
business days of contact, during normal business hours (8:30 am through 4:45 pm), unless the
requestor wishes to inspect the files at a later date.
DEC will evaluate
the application and the comments received on it to determine whether to hold
a public hearing. A public hearing may be legislative or adjudicatory. A legislative public
hearing is a proceeding which provides an additional opportunity for public comment. DEC’s
determination to hold a legislative public hearing will be based on whether a significant degree
of public interest exists. If a legislative public hearing is to be held, a Notice of Hearing
will be
published which will include the time and place of the hearing and submitting comments. The
applicant and all persons who have filed comments on the permit will be notified by mail of the
public hearing. Comments and requests for a legislative hearing should be in writing and
addressed to the Department representative listed below.
An adjudicatory public
hearing is a trial type proceeding which provides the opportunity for
adjudication on the basis of evidence, including direct testimony and cross examination. An
adjudicatory hearing is held only if substantive and significant issues relating to any findings or
determinations the Department is required to make pursuant to the Environmental Conservation

an existing surface discharge of 1500 gpd to an unnamed tributary of the Hudson River
under Article15 of the Environmental Conservation law. The modification would transfer

monitoring a monthly requirement and delete the disinfection requirements since
disinfection is not presently required for discharges to Class “C” water bodies. This
tentative determination indicates that the discharge regulated under this statute is
considered to satisfy regulatory standards for permit issuance, based on information
available to the Department at this time. As a tentative determination, the Department

decreased from 20 mg/l to 10 mg/l; c) ammonia effluent limits will be adjusted from 2

May of each year; d) daily visual inspections and chlorine residual and fecal coliform
monitoring will no longer be required; and e) additional monitoring requirements will be
imposed. This tentative determinatation indicates that the discharge regulated under this
statute is considered to satisfy regulatory standards for permit issuance, based on

Project Description: The Department has made
a tentative determination to approve this application for a new
permit for a proposed discharge of treated municipal sewerage into the Batavia Kill from a
proposed municipal treament plant with a design flow of 0.375 million gallons per day.
The new plant and associated sanitary sewer collection system will serve the hamlets of
Windham and Hensonville. The collection system will consist of construction of
approximately 15 miles of collection lines and will involve various stream crossings. The
treatment plant is to be located on South Street west of the hamlet of Windham and the
service area extends along State Route 23 and State Route 296 to the hamlet of
Hensonville. A draft permit is available for inspection and comment at the Region 4
