PROJECT
DESCRIPTION:
The applicant
proposes to mine sand and gravel from a 56.3 acre life of mine area on two parcels
totaling approximately 214 acres in the Town of Schaghticoke. The operation will include an
onsite wet processing plant (wash plant/settling pond system)and be conducted in 5 phases over
an estimated operational life of 10 to 15 years. The proposed project site is located on the north
side of NYS Route 67, approximately one mile west of the intersection of NYS Route 67 and
NYS Route 40.
PERMITS:
The applicant
has applied for a New York State Mined Land Reclamation permit under
regulations 6 NYCRR Part 420; NYSDEC application number # 4384200081/00001.
PUBLIC HEARING
AND WRITTEN COMMENT PERIOD:
All persons, organizations,
corporations or government agencies which may be affected by the
proposed project are invited to comment on the application. A Legislative Public Comment
Hearing on the application will be held to receive unsworn statements from the public on July 2,
2002 at 7:00 p.m. at the Schaghticoke Town Hall, Northline Drive, Melrose, NY.
It is not necessary
to file a written request in advance to speak at the legislative hearing. Written
statements and comments on the application are encouraged and any statements and comments
may be filed prior to or at the hearing, but no later than July 5, 2002.
Written comments
should be submitted to the attention of: Thomas Haley, Environmental
Analyst, NYS Department of Environmental Conservation, Division of Environmental Permits,
Region 4 Headquarters, 1130 North Westcott Road, Schenectady, NY 12306.
This hearing location
is reasonably accessible to persons with a mobility impairment. Interpreter
services may also be made available to deaf persons, at no charge, upon written request to the
Regional Permit Administrator named below, no less than one week prior to the hearing,
pursuant to SAPA § 202(1).
All persons having
an interest in this project are urged to attend or be represented either
individually or collectively.
Following the
hearing, the Department will make a determination on whether substantive or
significant issues have been raised as defined in 6NYCRR Part 621 Uniform Procedures and an
Adjudicatory Hearing Issues Conference should be scheduled before an Administrative Law
Judge. In order to raise substantive and significant issues written comments expressing
objections to or opposition to the application must explain the basis of that opposition and
identify the specific grounds which could lead the Department to deny or impose significant
permit conditions on the project.
NOTE: The Department
reserves the right to cancel the Legislative Public Comment
Hearing scheduled for July 2, 2002, if no written comments are received by COB on June
28, 2002.
