Project Description:

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
Coastal Management: This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:
The applicant proposes to construct a dam to impound a 2.5 acre pond on a 200 acre parcel on Shady Grove  Road.

The proposed dam will meet permit issuance standards for a Class A hazard dam, the lowest hazard class on a scale of A, B, and C.  The dam will impound 24 acre feet of water (7,821,000 gallons) when filled to its service spillway crest (the highest water elevation with no spillway discharge) and 28.2 acre feet (9,189,000 gallons) at its design high water after a 100 year precipitation event, while maintaining 1.2 feet of freeboard. The area draining into the pond is approximately 54 acres.  The service and auxiliary spillways will drain to an existing small intermittent tributary of Cutler Creek, which joins Cutler Creek after crossing under Shady Grove Road through a culvert approximately 1000 feet downstream of the dam site.  

The dam will be 12 feet wide at its top and 25 feet above the lowest point at its downstream toe.  The  maximum slope on the upstream (pond) side of the dam will be no steeper than one foot of vertical rise to three feet of horizontal run and on the downstream (dry) side of the dam no steeper than one foot of vertical rise to two feet of horizontal run.  The service and auxiliary spillways are designed to prevent overtopping of the dam from a 100 year rainfall event with a water level at the service spillway crest at the beginning of the of the event.
