Project Description: In
Bronx County, at the above address, add a 100' x 100' lot adjacent to and
immediately north of the facility site to expand and reconfigure the facility's C&D
operation, add on-site truck queuing, reduce and restrict on-street truck queuing, and
allow the facility to operate with its doors closed. Also, plant four trees on the sedewalk
in front of the facility. The modification includes no increase or change in the facility's
currently authorized waste stream of 1,600 cubic yards a day of C&D. The volume of
material stored on-site would remain unchanged. The facility's hours of operation would
remain 6am-6pm, Monday through Saturday; closed Sunday.

Project Description: The Department has prepared
a draft permit and has made a tentative determination to
approve this application. The existing Hugo Neu Schnitzer East - Queens Yard facility is
located at 30-27 Greenpoint Avenue, Long Island City, NY 11101. This is a minor Title
V modification for the permit issued on 10/19/2001 for this facility. The modification
involves an increase in the number of permitted operating hours for the main engine-generator (emission
unit 2-00002, emission point 0001). The main engine's operating
hours are to be increased from 2700 hours to 3050 hours per year upon the issuance of
this Title V modification. This modification results in no net NOx emissions increase;
therefore, New Source Review, 6 NYCRR 231-2, is not applicable to this faciity and this
modification qualifies as a minor modification. The modification impacts the maximum
gallons of fuel (#2 diesel oil) from 814,600 to 919,600 gallons annually and the tons of
scrap metal processed from 450,000 to 500,000 tons annually.
In accordance with 6NYCRR
Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the
United States Environmental Protection Agency (USEPA) has the authority to bar
issuance of any Title V Facility Permit if it is determined not to be in compliance with
applicable requirements of the Clean Air Act or 6 NYCRR Part 201.
Persons wishing to inspect
the subject Title V files, including the application with all
relevant supporting mateials, the draft permit, and all other materials available to the
DEC (the "permitting authority") that are relevant to this permitting decision should
contact the DEC representative listed below. It is recommended that an appointment be
made to confirm the availability of the subject files at a late date.
DEC will evaluate the application
and the comments received on it to determine whether
to hold a public hearing. A public hearing may be legislative or adjudicatory. A
legislative public hearing is a proceeding which provides an additional opportunity for
public comment. DEC's determination to hold a legislative public hearing will be based
on whether a significant degree of public interest exists. If a legislative public hearing is
to be held, a Notice of Hearing will be published which will include the time and place of
the hearing and submitting comments. The applicant and all persons who have filed
comments on the permit will be notified by mail of the public hearing. Comments and
requests for a legislative public hearing should be in writing and addressed to the
Department representative listed below.
An adjudicatory public hearing
is a trial type proceeding which provides the opportunity
for adjudication on the basis of evidence, including direct testimony and cross
examination. An adjudicatory hearing is held only if substantive and significant issues
relating to any findings or determinations the Department is required to make pursuant to
