Public Notice of Adoption
Pursuant to Chapter Sixty of the Consolidated Laws of New York, Section 19, the Department of Environmental Conservation hereby gives notice of the following rulemaking action:
A notice of adoption was filed with the Department of State on May 7, 2002, effective June 6, 2002, to adopt regulations contained in 6 NYCRR Part 638, mandated by Section 19 of New York State Tax Law.
The regulations set certain standards and other requirements that must be met, in addition to the requirements of section 19 of the Tax Law, for a building to be a "green building" and for "tenant space" to be designated as "green tenant space" as those terms are defined in section 19 of the Tax Law; and set the methods by which taxpayers must demonstrate compliance with those standards and requirements to be eligible for green building tax credit.
