Project Description: The applicant proposes to
place boulder retards at several locations in the bed of the
Chubb River between points just downstream of the Mill Pond Dam and the Route 73
Bridge to create pools and eddies in the river and enhance its flow characteristics for
whitewater canoe and kayak use. A staircase made out of native stone will also be
constructed on the south bank just downstream from the dam to allow for easier access to
the river by canoeists and kayakers. The project will create a suitable whitewater slalom
training site for Olympic athletes within a short distance from their main training facility.

Project Description: This permit modification
is in response to GE’s request for hearing on their original Title
V Permit. As a result of GE’s comments, changes were made to the original permit and
this notice is being published to provide another opportunity to the public to provide
comments to the department on the revised draft permit. The revised draft reflects
correction of lists of sources subject to various requirements. Other changes involve the
clarification of regulatory terms, reliance upon regulatory citations to describe certain
federal requirements, clarification of permit provisions requiring compliance certification,
inclusion of provisions previously omitted from the permit, revisions to certain
notification and general conditions language. These changes do not affect any emission
limits or standards and do not authorize any additional activities at the facility. A copy of

General Electric operates
a silicone production facility (sic 2821) located in Saratoga
County, New York, in the town of Waterford. The plant is approximately 12 miles north
of Albany. The site produces silicone products and other materials including resins,
fluids, dispersions, emulsions, heat curing elastomers, room temperature vulcanizing (rtv)
elastomers and fumed silica. The site has continuous and batch chemicals processes,
compounding, finishing and packaging operations, and steam generation capability.
Persons wishing to inspect
the subject Title V files, including the application with all
relevant supporting materials, the draft permit, and all other materials available to the
DEC (the “permitting authority”) that are relevant to this permitting decision should
contact the DEC representative below. It is recommended that an appointment be made
to confirm the availability of the subject files. The DEC will endeavor to make the files
available within 2 business days of contact, during normal business hours (8:30 a.m. to
4:45 p.m.), unless the requestor wishes to inspect the files at a later date.
DEC will evaluate the application
and the comments received on it to determine whether
to hold a public hearing. A public hearing may be legislative or adjudicatory. A
legislative public hearing is a proceeding which provides an additional opportunity for
public comment. DEC’s determination to hold a legislative public hearing will be based
on whether a significant degree of public interest exists. If a legislative public hearing is
to be held, a Notice of Hearing will be published which will include the time and place of
the hearing and submitting comments. The applicant and all persons who have filed
comments on the permit will be notified by mail of the public hearing. Comments and
requests for a legislative hearing should be in writing and addressed to the Department
representative listed below.
An adjudicatory public hearing
is a trial type proceeding which provides the opportunity
for adjudication on the basis of evidence, including direct testimony and cross
examination. An adjudicatory hearing is held only if substantive and significant issues
relating to any findings or determinations the Department is required to make pursuant to
the Environmental Conservation Law exist. A copy of the Department’s permit hearing

The permit application and
draft permit are available for review at the Warrensburg DEC
Office. Comments will be received for 30 days from the date of this notice. If comments
are received which raise significant issues or provide additional relevant information, the
Department may modify the Draft modified Title V Facility Permit.
In accordance with 6 NYCRR
Parts 621.5 (d) and 2016.4(c), the Administrator of the
United States Environmental Protection Agency (USEPA) has the authority to bar
issuance of any Title V Facility Permit if it is determined not to be in compliance with the
applicable requirements of the Clean Air Act or 6 NYCRR Part 201.
