Availability of Remediation Work Plan for Comment

Site Name and Number: TRC East Side Properties, New York, N.Y. (V-00431-2)

Project Location: This property consists of a 2-acre parcel located at 708 First Avenue, New York County, NY, NYSDEC Region 2.

Project Description: This property is currently owned by Consolidated Edison Company of New York, Inc. ("Con Edison"). Con Edison has contracted with TRC Companies, Inc., to assume the liability and responsibility for abatement, decommissioning, demolition and remediation of the site. The site includes a vacant 400,000 square feet office building, locker room and two industrial buildings. The site was formerly used for office space and electrical operations from the 1920’s until 2001. Portions of the site were used for manufactured gas plant operations from the 1890's until 1923. TRC has investigated environmental conditions at the site pursuant to a DEC-approved Supplemental Soil Investigation Work Plan, dated March 2001. Additional work was undertaken pursuant to a DEC-approved Addendum to the Supplemental Soil Investigation Work Plan, dated October 2001. The investigation found elevated levels of volatile organic compounds (VOCs), semi-volatile organic compounds (SVOCs) and metals in soils. In groundwater, slightly elevated levels of VOCs were found. These results are reflected in a Supplemental Soil Investigation Final Report, which is being made available for review (see document repositories listed below) in conjunction with the Remediation Work Plan.

The preferred remedy for this site calls for: 1) decommissioning and removing all underground storage tanks and associated structures; 2) removing soil containing elevated levels of VOCs, SVOCs, and metals; and 3) monitored natural attenuation of VOCs in groundwater. In addition, based on the final post remediation sampling results, institutional controls, such as a deed restriction, will be required.

Comment Period: The Remediation Work Plan for the property described above is available for review at the locations set forth below. Written comments on this action must be received by the contact person below within 30 days of this Notice. Written comments expressing objections or opposition to the Remediation Work Plan must explain the basis of the opposition and identify the specific grounds that could justify the Department's imposing significant changes to the work plan. No formal response is made to comments, but as a result of comments, the Department may reevaluate and revise the Remediation Work Plan. Proposed Action: Waste Management has withdrawn its proposals to operate on Sundays and to define its putrescible waste capacity as a monthly average, but has submitted an application to convert 300 tons of the facility's sewage grit and screenings capacity to 300 tons of putrescible solid waste. This conversion would not change the number of trucks servicing the facility.

Brooklyn - The New York City Planning Commission, as lead agency, has determined that the proposed Love Fellowship Tabernacle Church will not have a significant adverse environmental impact. The action involves the renovation of the two-story, factory building, currently in use as a church. The project is located within an M1-1 district at 464 Liberty Avenue (Block 3708, Lot 11) in Brooklyn, Community District 5.

Manhattan - The New York City Planning Commission, as lead agency, has determined that the proposed 36 Laight Street will not have a significant adverse environmental impact. The action involves the development of two loft dwelling units with approximately 3,732 sq. ft. of gross floor area on the second floor of an existing 7-story loft building located at 36 Laight Street (Block 220, Lot 27).

Positive Declaration and Notice of Acceptance of Draft Supplemental EIS and Public Hearing

New York City (Brooklyn) County - The Metropolitan Transportation Authority, as lead agency, has determined that the proposed Atlantic Terminal Office Development may have a significant adverse impact on the environment and a Draft Supplemental Environmental Impact Statement has been prepared. A public hearing on the Draft Supplemental Environmental Impact Statement will be held on May 16, 2002 at 4:00 p.m. at the Fire Department Auditorium, 9 Metro Tech Center (enter from Metro Tech Center Commons), Brooklyn, New York. Written comments on the Draft Supplemental EIS will be accepted until May 31, 2002. Copies of the DSEIS are on file at the MTA and are available to the public through the contact person listed below. A copy of the DSEIS is also available for public review at the Brooklyn Public Library, Grand Army Plaza, Brooklyn. The action involves the construction of a commercial office development consisting of up to approximately 425,000 square feet of gross floor area (gsf) including mechanical space in Downtown Brooklyn. The project site currently contains the below-grade Long Island Rail Road Flatbush Avenue Terminal and the Altantic Avenue subway station complex. Above grade, construction of an approximately 470,000 gsf retail development has recently commenced on the project site, consisting of four stories above grade plus a partial cellar level. That retail development was the subject of an EIS in 1999, which was reviewed and approved by the MTA in its capacity as lead agency. This DSEIS, supplementing the 1999 EIS, looks at whether the changes proposed for the site may result in any significant adverse environmental impacts. MTA has determined that the project may result in a significant adverse impact on open space. The project is a Type I action and scoping has not been conducted. The project block is bounded by Flatbush Avenue, Atlantic Avenue, Hanson Place and former Fort Greene Place in Brooklyn, New York.
