Project Description:
The Department has made a tentative determination to approve a modification to the existing Air State Facility Permit and prepared a draft permit for the plant located at 3020 Truax Road, which manufactures heat exchangers and air pollution control equipment.
The facility is subject to the volatile organic compounds (VOC) control requirements contained in 6 NYCRR Part 228 for surface coating lines.  In the effort to comply with Part 228, the applicant has demonstrated that alternative compliant coatings are currently not available for use, and has completed a reasonably available control technology (RACT) analysis using procedures contained in Air Guide 20.  The Department has reviewed that RACT analysis for VOC and determined that control of  VOC as required by Part 228 is not feasible due to the cost of installing, maintaining and operating controls.  Consequently, the Department, has tentatively determined that the facility should be granted a variance from the control requirements of  Part 228.  The proposed permit contains enforceable conditions which establish a basis for approving the variance and all other applicable emission control requirements for the facility's air emission sources.  The conditions also set limits on VOC emissions which correspond to those used in the RACT analysis and require an annual review of feasible control technologies.
 The issued permit will be submitted to the Environmental Protection Agency for review and approval of a single source revision of the State Implementation Plan.  The subject application, draft permit, relevant supporting materials and regulations are available for review at the Department's Region 9 Office, Buffalo, during normal working hours.          
State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:
To facilitate the Riverside Road bridge replacement, the applicant proposes to construct two temporary riprap causeways in Conewango Creek for access to remove and install bridge abutments and piers.   In order to not block stream water flow completely, the causeways will be constructed in phases.  The first causeway to be constructed will be approximately 143.5 feet in length, extending from the east bank.  Upon removal of the first causeway, the second causeway will be constructed, extending from the west bank approximately 102.5 feet.  The project site is at Riverside Road over Conewango Creek, approximately 2,000 feet southwest of the intersection of County Route 53 and Riverside Road.
State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

The Department has prepared a draft permit and made a tentative determination to issue a State Pollution Discharge Elimination System permit (NY-0259098) for the discharge of non-contact cooling water to Tonawanda Creek (Erie Canal) which has a Water Index Number of  O-158-12, Item 19 and a classification of  C. The proposed discharge rate would be about 8,400 gallons per day. The draft permit, fact sheets, application, and applicable regulations are available for inspection at the NYSDEC Region 9 Office.

Project Description:
As part of the development of the 57 lot Gramercy Park Estates Subdivision, it is proposed to  grade and landscape portions of nine lots within the regulated 100 foot wide adjacent area of the Casey Road (CC-8) Wetland, a class I wetland.  Moreover, construction of single family residences (including the installation of fences, pools, decks, gazebos, and construction of outbuildings) are proposed on those nine lots within 70 feet of the CC-8 Wetland.  Consequently, those residences and related structures or facilities on those lots may be within the first 30 feet of the regulated 100 foot wide wetland adjacent area.  In addition,  an outlet pipe from a proposed storm water detention basin within the subdivsion will be installed through the berm along Gott Creek.  The Gramercy Park Estates Subdivision site is located north of the existing Pines and Pines East Subdivisions on the north side of Casey Road just west of Gott Creek.  Development of the site was originally proposed in 1975 as the Pines North Subdivision.  The applicant intends to donate 25 acres of the approximately 61 acre site to the Town of Amherst for open space use.  Those 25 acres contain that portion of the CC-8 Wetland on the site as well as undeveloped upland.
