Project Description:
Due to a change in site ownership, it is proposed that the outfalls in existing SPDES permit NY0108537 be split between a previous owner and the current owner.  Chicago Pneumatic will retain outfall 03A, the groundwater treatment system.  All other outfalls (001, 002 and 003) will be transferred to new SPDES permit NY0257087 which has been assigned to Utica Holding Company.

Compared to the previous permit requirements applicable to outfalls 001, 002 and 003, the following changes are proposed:

The permit and fact sheet format have been updated.  Due to the inherent inaccuracy of using instantaneous flow measurements to determine compliance with mass-based permit limits, all mass-based permit limits have been replaced by concentrations.  Cadmium and selenium monitoring has been eliminated.  PCB monitoring has been reduced by 96% and use of a new analytical method is required.  Antimony and phenols monitoring has been reduced by 50%.  A short term monitoring program is required for TDS.  Acute toxicity testing results at outfalls 001 and 002 justify now requiring chronic testing.
State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.
SEQR Lead Agency: NYS Department of Environmental Conservation
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:
    The Department of Environmental Conservation (DEC) has received an application to re-issue the following EPA minor Private/Commercial/Institutional State Pollution Discharge Elimination System (P/C/I SPDES) permit.  DEC has made a tentative determination to re-issue this permit for a five-year period, maintaining the current effluent limitations and monitoring and reporting requirements.  This permit involves the surface discharge of up to 16,200 gallon per day of treated sanitary waste to the Black River Tributary.

    Additional information including the current permit, renewal applications, and supporting documentation may be obtained from, or inspected at the NYSDEC central office in Albany.  Substantive comments on the permit or requests for a hearing or both must be submitted in writing to the contact person.
