The applicant proposes to excavate 800 cubic yards of material from a 205 ft. x 13 ft. area landward of the existing bulkhead to a depth of 4 ft. below mean low water and remove the existing 205 linear ft. of bulkhead and replace 13 ft. landward; dredge 42 cubic yards of material from a 13 ft. x 36 ft. area on the south side of the existing wavebreak to a depth of 4 ft. below mean low water and remove the existing 72 linear ft. wavebreak and replace 13 ft. south of the existing location; install 13 linear ft. of new bulkhead; remove and replace in the same location 38 linear ft. of bulkhead; construct 51 linear ft. of capping boardwalk, and relocate the existing float systems.  Resultant 842 cubic yards of dredged material will be removed off site to an approved upland location.  The site is located at 3000 Whaleneck Drive, Merrick, Town of Hempstead, County of Nassau, on Merrick Creek.

The applicant proposed to construct a 2.3 million gallon capacity recharge basin immediately adjacent to two existing recharge basins.  The recharge basins are used for stormwater and cooling water discharges at the Relativistic Heavy Ion Collider (RHIC) facility.  A small Tiger Salamander breeding pond is also proposed adjacent to the new basin.   The basin is proposed to be located within the RHIC ring near the center on the Brookhaven National Laboratory site in Upton, Town of Brookhaven, Suffolk County.

Project Description:
The applicant proposes to restore and enhance eight acres of marsh through removal of 5000 cubic yards of dredge spoil and an exisiting dike, controlling phragmites populations and modifying the current vector control ditch network. Phragmites will be mowed and mulched; the breaching of the dike will result in greater tidal inundation to the marsh and soil salinity will subsequently increase.  The breaching of the existing dike in three places will contribute to the restoration efforts. Existing vector control ditches will be cleaned and the primary ditch will be converted into a "tidal creek" which terminates in a small pool that will serve as a fish reservoir.  The property is located on Clover Lane, on Beaverdam Creek, Brookhaven.

The applicant proposes to realign lot lines on two neighboring properties with a total area of 255,382 square feet. Two new lots will be created with one of 168,381 square feet on the waterfront and one of 87,001 square feet landward of the first lot.
