Negative Declaration and Public Hearing

Broome County - The Town Board of the Town of Dickinson, as lead agency, has determined that the proposed Local Law entitled, A Local Law Amending 108-1 entitled, Definitions and Word Usage, 108-14 entitled, Special Permit Standards and 108-36 entitled, Special Permits Conditions of the Code of the Town of Dickinson will not have a significant adverse environmental impact. A public hearing will be held on May 6, 2002 at 5:30 p.m. at the Dickinson Town Hall, 842 Front Street, Binghamton, NY. Said Local Law shall amend the Code of the Town of Dickinson as follows:

Section 108-1, Definitions and word usage, is hereby amended to add the following definitions:

CONVENIENCE STORE - An establishment offering the retail sale of consumer merchandise, food products, automotive fuel, oil and motor vehicle accessories and which may include facilities for lubricating, washing or servicing motor vehicles, but not including painting or major repairs to vehicles.

GASOLINE SERVICE STATION - Any building or land that is used for the sale of motor fuel, oil and motor vehicle accessories, but not sale of general consumer merchandise and food products, and which may include facilities for lubricating, washing or servicing motor vehicles, but not including painting or major repairs to vehicles.

Section 108-14, Special permit standards, is hereby amended as follows:

A. Uses permitted after the issuance of a special permit by the Town Board shall conform as follows:

(2) All other applicable provisions for the district for which said use is permitted unless said provisions are waived by the Town Board.

B. (4) The Town Board shall review the site and make a determination that the use will not constitute a traffic hazard. Conditions may be placed on the special permit, if deemed necessary by the Town Board.

C . (5) The proposed use and location shall be referred to the Town Planning Board for recommendations.

(2) The location shall be such as to offer reasonable protection to the neighborhood against possible detrimental effects, taking into consideration the physical relationships to surrounding properties and access to the site over any nearby residential streets. The Town Board shall determine appropriate safeguards after review of the site plans.

Section 108-36, Special permits; conditions, is hereby amended as follows:

A. All uses in the Highway Interchange Commercial District (H-C) shall be subject to the issuance of a special permit by the Town Board, pursuant to the standards set forth in 108-14. If a special permit is granted by the Town Board, the Planning Board shall thereafter conduct site plan review. In making its review of proposed site plans, the Planning Board shall be guided by the provisions set forth in 108-36, as well as those of 108-13 of this chapter.

B. Vehicle service and repair stations and convenience stores.

B. (1) No gasoline service station or convenience store shall be located within 150 feet of a lot or parcel occupied by a public school, public or private hospital, public library or a church. The measurement distance shall be from the closest lot line to the closest lot line.

The change affects the entire area within the Town of Dickinson, Broome County.

Negative Declaration

Tompkins County - The Town Board of the Town of Ithaca, as lead agency, has determined that the proposed Town of Ithaca Public Works Facility will not have a significant adverse environmental impact. The action involves project approval from the Town of Ithaca Town Board, Site Plan approval from the Town of Ithaca Planning Board, and Special approval from the Town of Ithaca Zoning Board of Appeals for the proposed expansion and renovation of the Town of Ithaca public works facility located at 106 Seven Mile Drive, Town of Ithaca Tax Parcel No. 33-2-6.1, Residence District R-30. The proposal includes the renovation of +/- 10,900 square feet of existing space and the addition of +/- 16,000 square feet of new space to include new offices, breakroom, conference room, maintenance bay, wash bay, and storage space, and modifications of the existing parking area. The project is located at 106 Seven Mile Drive in the Town of Ithaca.
