Project Description:
    The Department of Environmental Conservation (DEC) has received an application to re-issue the following EPA minor Private/Commercial/Institutional State Pollution Discharge Elimination System (P/C/I SPDES) permit.  DEC has made a tentative determination to re-issue this permit for a five-year period, maintaining the current effluent limitations and monitoring and reporting requirements.  This permit involves the surface discharge of up to 1,500 gallon per day of treated sanitary waste to the Ouaquaga Creek.

    Additional information including the current permit, renewal applications, and supporting documentation may be obtained from, or inspected at the NYSDEC central office in Albany.  Substantive comments on the permit or requests for a hearing or both must be submitted in writing to the contact person.

Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

This is a renewal application with a modification to expand the existing permitted sand and gravel mine, by 1.4 acres on the south end of the mine.  No mining is proposed in a potentially sensitive archaeological/cultural area, which is located to the east of the current mine.  Location: Donald Worsell's Blakley Road Mine, Blakley Road, Genoa (T), Cayuga County.
State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

Project Description:
    Nichols Distribution Center and Site Development - The proposed project which has been the subject of Draft and Final Environmental Impact Statements will include the construction of a one million square foot distribution center building (expected to be expanded by 600,000 square feet in the future).  The proposed footprint requires the relocation of a portion of Hunts Creek and Smith Creek Roads, the stabilization and/or relocation of portions of Smith and Hunt Creeks, the filling of approximately 1730 feet of an unnamed intermittent tributary to Smith Creek, and the loss of approximately 0.48 acres of United States Army Corps of Engineers jurisdiction freshwater wetland (this loss will be mitigated by the creation of approximately 0.80 acres of freshwater wetland).  In addition, the construction of a sewage treatment plant will require an outfall or discharge pipe to the Susquehanna River for which an estimated 30 cubic yards of riprap will be required to secure the outfall.  While this project will also require Water Supply and State Pollutant Discharge Elimination System Permits for the water supply and the  wastewater discharge respectively, these permit applications will be publically noticed at a later date.
State Environmental Quality Review (SEQR) Determination: A draft environmental impact statement has been prepared on this project and is on file.
SEQR Lead Agency: Tioga County Industrial Development Agency
State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
