The Department has received a request to issue a permit and has drafted an Article 19 (Air Pollution Control) of the New York State Environmental Conservation Law, an Air State Facility Permit, at the facility located at F.E. Hale Manufacturing Company, North Frankfort Industrial Park, Frankfort, New York.  The facility manufactures wooden bookcases for offices and libraries.

The facility is a synthetic minor source under the Title V (6 NYCRR Part 201-6) and PSD/NSR (40 CFR Part 52.21 and 6 NYCRR Part 231-2, respectively) definitions for the emissions of Individual Hazardous Air Pollutants (HAP), Cumulative Hazardous Air Pollutants (HAPs), and Volatile Organic Compounds (VOCs). The facility is a minor source under the Title V and PSD/NSR definitions for particulate matter (PM), particulate matter less than 10 microns in mean aerodynamic diameter (PM-10), carbon monoxide, oxides of nitrogen (NOx), and sulfur dioxide (SO2).

This permit includes Federally enforceable conditions to "cap" emissions below the applicable threshold level set forth in 6 NYCRR Part 201.6(a), 6 NYCRR Part 231-2, 6 NYCRR part 212.10, 6 NYCRR part 228.8, and 40 CFR 52.21 for Volatile Organic Compounds (VOCs) at 95,000 pounds per any consecutive 365 day period.  This permit also includes Federally enforceable conditions to "cap" emissions below the applicable threshold levels set forth in 6 NYCRR Part 201.6(a) and 40 CFR 63 Subpart JJ at 47,500 pounds and 19,000 pounds of Cumulative Hazardous Air Pollutants, respectively.  The draft permit with conditions is available for review in the Region 6 NYSDEC office in Watertown, New York.
State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

The facility is located 2,000 feet south of NYS Rt. 28, approximately 4,000 feet southwest of Thendara in the town of Webb.

The applicant proposes to bury a 6" PVC pressurized pipeline to transfer cow manure from his farm at 2121 Kelly Road to a loading port on NYS Route 812, opposite Winters Road, 4.25 miles south of Heuvelton.  The pipeline would be excavated 3' below grade and would impact approximately 2000' of regulated freshwater wetland HV-14, a 3944 acre Class I wetland.  The project would eliminate approximately two miles of over the road hauling.

The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the New York State Environmental Conservation Law and Title V of the Federal Clean Air Act Amendments and made a tentative determination to approve this application for the existing facility located at Alcoa, Inc., Alcoa Massena Operations, Massena, New York.

The facility is a "major" source under the Title V (6 NYCRR Part 201-6) and PSD/NSR (40 CFR Part 52.21 and 6 NYCRR Part 231-2 respectively) definitions for the emission of Particulate Matter (PM), PM-10 (particulate with an aerodynamic cross section of 10 microns or less), Volatile Organic Compounds (VOCs), Carbon Monoxide (CO), Oxides of Nitrogen (NOX), Sulfur Dioxide (SO2), and Fluorides.  The facility is also major under Title V for Hazardous Air Pollutants (HAPs), Hydrogen Chloride, Hydrogen Fluoride, and Polycyclic Organic Matter (which includes Polycyclic Aromatic Hydrocarbons).  The facility is subject to 40 CFR 63 subpart LL for Primary Aluminum Reduction Plants and 40 CFR 63 subpart RRR for Secondary Aluminum Production.  A "Best Available Control Technology" (BACT) analysis has been submitted to the NYS Department of Environmental Conservation pursuant to 6 NYCRR Part 212.5(d) for the emission of Carbonyl Sulfide, Sulfur Dioxide, and Carbon Monoxide from the potline and the anode bake furnace.  The facility has accepted a limit on the sulfur content of the coke used in the making of the anodes at 2.5% by weight, and Albany DEC staff has accepted this as meeting the BACT requirements.  Another BACT analysis will be submitted within 90 days of issuance of the permit to show compliance with 6 NYCRR Part 212.5(d) for chip dryer #1 (emission point I0029) for emissions of CO.

In accordance with 6 NYCRR Part 621.5(d)(9) and 201-6.4(c), the Administrator of the Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act of 6NYCRR Part 201.  After the public comment period, the USEPA will be provided a proposed permit and will have an additional 45 day period for review.  If USEPA does not raise any objection, the Department will issue the permit. The application and Draft Title V Facility permit are available in the Region 6 NYSDEC office in Watertown, New York.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative below.  It is recommended that an appointment be made to confirm the availability of the subject files.  The DEC will endeavor to make the files available within 2 business days of contact, during normal business hours (8:30 am through 4:45 pm), unless the requester wishes to inspect the files at a later date.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing.  A public hearing may be legislative or adjudicatory.  A legislative public hearing is a proceeding which provides an additional opportunity for public comment.  DEC's determination to hold a legislative public hearing will be based on whether a significant degree of public interest exists.  If a legislative public hearing is to be held, a Notice of Hearing will be published which will include the time and place of the hearing and submitting comments.  The applicant and all persons who have filed comments on the permit will be notified by mail of the public hearing.  Comments and request for a legislative hearing should be in writing and addressed to the Department representative listed below.

An adjudicatory public hearing is a trial type proceeding which provides the opportunity for adjudication on the basis of evidence, including direct testimony and cross examination.  An adjudicatory hearing is held only if substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Conservation Law exist.  A copy of the Department's permit hearing procedures is available upon request or on the Department's website at: http://www.dec.state.ny.us/website/ohms/gudph1.htm
