Project Description:
The applicant proposes to reconstruct 163 feet of bulkhead in-place, construct two returns and two retaining walls, remove two boat houses and construct 48 feet of new bulkhead to close off two boat slips.  Two hundred and seventy five cubic yards of fill will be placed within the boat slips, resulting in the loss of approximately 1,500 square feet of tidal wetlands known as littoral zone (SM/LZ).  An additional 175 cubic yards of fill will be placed landward of the bulkhead as backfill.  The applicant also proposes to reconstruct an existing boardwalk and construct 48 feet of new boardwalk.  The project is located at 2461 Jackson Avenue, Seaford, Town of Hempstead, Nassau County, NCTM# Section 85, Block 152, Lots 5, 6, 9 & 10.  
State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment: Comments on this project must be submitted in writing to the Contact Person no later than Apr 26 2002.

Project Description:
The applicant proposes to close off an existing boat slip.  The boat slip occupies an area of approximately 307 square feet and measures approximately 22 linear feet along its opening into Pershing Inlet.  A bulkhead will be constructed across this opening, after which the boat slip will be filled in using approximately 100 cubic yards of clean fill from an upland source.  This project is being undertaken in conjunction with the replacement of existing sections of bulkhead and boardwalk as well as maintenance dredging to capture approximately 8 cubic yards of spoil.
State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

State Environmental Quality Review (SEQR) Determination: Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.
SEQR Lead Agency: Brookhaven Town Planning Board
State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management: This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
