Project Description: The applicant has requested
an increase in the allowable pH ( from pH 8 to pH 9 ) for the
discharge from the existing municipal composting site run-off collection and treatment
system. Specifically the the effluent pH limit will be increased from the constructed
wetlands treatment system which flows to a roadside, State Rt. 263, swale and then into
Tonawanda Creek . The applicant has evaluated the pH rise in the pond and concluded it
is due to algal photosynthesis.
The Department has also
deleted compliance schedules which have been satisfactorly
completed and added new requirements for monitoring and restoring the wetland values
of the constructed wetland area.

Project Description: The Department has drafted
modified permit pages and made a tentative determination to
modify the Part 373 Permit for Occidental Chemical Corporation's Niagara Plant located
at Buffalo Avenue and 47th Street in the City of Niagara Falls. The facility's existing
manufacturing operations generate hazardous wastes, which are stored in containers and
tanks, and either sent for off-site disposal or incinerated in an on-site incinerator. The
facility has had an on-site incinerator in operation since 1961. Pursuant to a Part 373
Permit issued in 1988 and renewed in December 1999, the facility has been receiving,
storing and incinerating hazardous wastes generated at other Occidental-owned facilities
in western NY and hazardous remedial wastes containing dioxins and polychlorinated bi-phenyls (PCBs)
from Occidental's remedial sites in western NY and Occidental's Taft,
Louisiana facility. The December 1999 Permit was modified in September 2000 to
authorize the facility to receive and incinerate the distillate waste from the Durez Plant in
Niagara Falls (Durez Distillate). The incinerator treats chlorinated plant production
wastes and remedial waste streams from Occidental remedial sites. Combustion gases
leaving the incinerator are cooled in a quench tower before they enter air pollution control
equipment. In March 1998, leaks at the bottom of the quench tower became evident and
Occidental personnel attempted through internal repairs and external patches to correct
the problems. By early 1999, however, the Department and Occidental agreed that these
measures were insufficient and a new quench tower should be installed. This tower was
replaced with a new one of different design in June 2000. Since the quench unit provides
significant removal of hydrochloric acid, particulate and other compounds, the
Department required that a stack test be performed by Occidental according to a
Department-approved protocol to confirm that the new quench tower performs
comparably with the previous unit. The quench confirmation stack test was performed in
June 2000, and the stack test report was approved by the Department in August 2001.
This permit modification will incorporate the new quench tower operating conditions and
related changes into the Part 373 Permit. This modification also withdraws the allowance
given to Occidental previously to incinerate Durez Distillate (an aqueous waste stream
containing organics) since the Durez Plant is no longer owned by Occidental and the new
owner decided to continue burning this waste in their permitted on-site incinerator.
However, in its place, Occidental will be allowed to incinerate aqueous waste stream
similar to Durez Distillate. In addition, Occidental is currently undergoing significant
reduction in production which has resulted in closure of several hazardous waste storage
tanks and container storage areas. These areas are being removed from the current
permit.
