Project Description:
The applicant proposes the construction of a 93 lot residential subdivision on a 101 acre site in the Town of Bethlehem, located south of Wemple Road and west of Route 9W. As a result of the development, 0.42 acres of federally regulated wetlands and waterways will be directly impacted and 0.05 acres will be temporarily disturbed for the installation of a utility line. As mitigation for the project, the applicant proposes the creation of  0.68 acres of wetlands on the project site, the establishment of wetland buffers, and the preservation of the remaining on-site wetlands. Necessary erosion and sediment control measures will be implemented to ensure the protection of water quality.
State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.
SEQR Lead Agency: Bethlehem Town Planning Board
State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:
    The Department of Environmental Conservation (DEC) has received an application to re-issue the following EPA minor Private/Commercial/Institutional State Pollution Discharge Elimination System (P/C/I SPDES) permit.  DEC has made a tentative determination to re-issue this permit for a five-year period, maintaining the current effluent limitations and monitoring and reporting requirements.  This permit involves the surface discharge of up to 9,000 gallon per day of treated sanitary waste to the Kaaterskill Creek.

    Additional information including the current permit, renewal applications, and supporting documentation may be obtained from, or inspected at the NYSDEC central office in Albany.  Substantive comments on the permit or requests for a hearing or both must be submitted in writing to the contact person.

The applicant proposes to construct a wastewater collection and treatment facility, which includes the construction of the wastewater treatment plant, outfall piping and outfall to the Hoosic River, and the Ella Street Extension.  The project involves the disturbance of +/- 9000 sq. ft. of forested federal wetlands (6,380 sq. ft. disturbance for outfall piping and outfall structure, and 2,775 sq. ft. disturbance for the Ella Street Collection System Extension).  The project also involves a new SPDES permit, which proposes to discharge an average of 60,000 gpd of treated sanitary wastewater to the Hoosic River.  The project is located on Poplar Street in the Village of Valley Falls, Town of Pittstown, Rensselaer County.  A draft SPDES permit is available for inspection and comment at the Region 4 Office.  SPDES #NY-0261360.
