The Department has made a tentative determination to approve this application for a new permit for a proposed discharge of 672 gpd of treated sanitary wastewater into a Class C(t) tributary of Fox Creek from Wright's Delights, a proposed restaurant/ice cream shop serving approximately 170 persons per day located on the west side of Main Street, just south of its intersection with Route 443, in the Hamlet of East Berne, Town of Berne, Albany County.  As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:
The Department has made a tentative decision to modify the existing State Pollutant Discharge Elimination Sytem (SPDES) permit for the discharge of a varying amounts of wastewater into two unnamed tributaries, Mosher Brook and Coeymans Creek. Outfall 009 will be added to identify the discharge from the air pollution control system on the primary rock crusher. Additionally, a compliance schedule allowing Lafarge until December 1, 2002 to acheive the 30 mg/l total suspended solids (TSS) limit, which was previous noticed during the week of August 24, 2001, is being proposed. The Lafarge Building Materials facility, formerly Blue Cirlce Cement, is located on Route 9 in the Town of Coeymans. A draft permit is available for inspection at the NYSDEC Region 4 Office. The Department has made a tentative determination to approve this application to modify the Mohawk View Plant State Pollutant Discharge Elimination System (SPDES) Permit for the discharge of treated wastewater into the Mohawk River. The permit modification request is in response to a variance granted by the USEPA for 40 CFR 403.8 which required the implementation of an Industrial Pretreatment Program for wastewater treatment facilities with a design capacity of greater than 5.0 million gallons per day (MGD). The NYSDEC permit modification will include a compliance schedule for the implementation of a Mini-Pretreatment Program which includes; conducting an industrial survey, developing procedures for ensuring compliance with applicable standards, conducting treatment plant and industrial monitoring, and implementing an updated Local Sewer Use Law. The applicant's facility is located on Onderdonk Avenue in the Town of Colonie. SPDES #NY-002 7758.
