Project Description: On January 15, 2002 in Part
II of the Federal Register [67FR2020-2095] the U.S. Army
Corps of Engineers announced the reissuance of all existing Nationwide Permits [NWPs]
, General Conditions, and definitions with some modifications and one new General
Condition pursuant to Section 404 of the Clean Water Act and applied for a Section 401
Water Quality Certification from the NYS Department of Environmental Conservation.
These General Permits address certain activities in the Waters of the United States that
have minimal adverse environmental effects.A Negative Declaration is on file.The
Permits may be viewed at: http//:www.usace.army.mil/inet/functions/cw/cecwo/reg/.
The New York State Department
of Environmental Conservation will decide for each
permit whether to issue, issue with conditions, or deny section 401 Water Quality
Certification.The Department's decision will be based on consideration of the NWP's
along with conditions limiting use of the Nationwides proposed by both New York State
and the US Army Corps of Engineers.
