Project Description: The Department has made a tentative determination to approve an application
for modification of the SPDES permit for the Toshiba Display Devices, Inc.
facility in Horseheads, NY to add a new effluent limit and monitoring requirement
for Total Organic Halogens at outfall 001. Outfall 001 is a sampling point located
just prior to a storm sewer which discharges to a tributary of Newtown Creek, off
of Chemung Street, just east of the plant. The modification is a result of a
request to add a new biocide, Biosperse 3010 to the cooling towers. In addition,
the Department is proposing a modification to change the acute toxicity testing to
chronic toxicity testing because the effluent flow exceeds 5 percent of the total
flow of the receiving stream. The application materials and draft permit are
available for review and comment at the regional office.

Project Description: The applicant mines salt which is later used for highway deicing. An application
has been received to add an agent to the salt which increases the efficiency of
the salt product for deicing. The agent is magnesium chloride and distillers
condensed solubles. The product is presently used by some Towns and the
NYSDOT with reports that overall salt useage is reduced. The draft permit which
is available for review requires a one year monitoring program to include
phosphorus, ammonia and nitrate/nitrite. The receiving water is the Genesee
River and the facility is located near Hampton Corners.

Project Description: The Department has received an application from Corning Incorporated for an
Air State Facility Permit to authorize construction of a new 403,000 square foot
manufacturing plant. To be known as the Corning Inc - Erwin Diesel Facility, it
will produce ceramic filters and substrates for diesel engine emission control
devices, and will be located at 9261Addison Road (NYS Route 417) in the Town
of Erwin, Steuben County.
Due to potential emissions of volatile organic compounds (VOC) in excess of 50
tons per year and hydrogen fluoride (HF) in excess of 10 tons per year, the plant
will meet the definition of a Major Source in 6 NYCRR Part 201-2.1(b)(21) and be
subject to regulations as specified in 6 NYCRR Part 201-6 Title V Facility
Permits, Part 231 New Source Review (NSR) in Ozone Transport Regions, and
40CFR63 Subpart B maximum achievable control technology (MACT)
requirements. Within a year of the start of operations, Corning Inc will be
required to submit a complete Title V application as specified in 6 NYCRR Part
201-6.
Facility operations will include raw materials processing, ceramic extrusion,
drying ovens, cutting and shaping, and kiln firing of the fabricated ceramic items.
The Draft Air State Facility Permit, as will the eventual Title V Facility Permit,
includes Special Permit Conditions to restrict facility emissions of:
Oxides of nitrogen (NOx) to 99 tons per
year, below the 6NYCRR Part 231-2.2 NSR threshold of 100 tons
per year;
VOC to 122 tons per year, the level of emissions
authorized by the emission
offsets obtained for this facility
pursuant to 6NYCRR Part 231-2.9;
Particulates, to 249 tons per year, below
the 250 ton per year threshold for
40CFR 52.21, Subpart A Prevention
of Significant Deterioration (PSD)
for new facilities in compliance areas.
In accordance with Part 231-2.2 NSR requirements for VOC, Corning Inc has
obtained VOC emission offsets 1.15 times the facility's proposed 122 ton per
year VOC emission potential. VOC emissions from the ceramic kilns will be
controlled by Thermal oxidizers to achieve "Lowest Achievable Emission Rate"
(LAER). Emissions of HF, subject to MACT requirements, will be controlled by
wet and dry scrubbers.
The application and Draft Permit is available for review at the Region 8 NYSDEC
office.

Project Description: The applicant has proposed to mine topsoil and sand from a 175 acre Life of
Mine within a 205 acre parcel located northwest of, and bounded by, the
intersection of Rose Valley Road and NYS Route 31. The initial phase of the
operation will consist of a five acre permit term where 5 acres of topsoil and 2 to
3 acres of sand will be extracted by bulldozer and tracked excavator to a depth
not to exceed 15 feet. Proposed as a cut and haul operation, most material will
be loaded directly onto awaiting trucks, with only small amounts of topsoil
stockpiled. There will be no on site processing or washing. Permitted term areas
will be reclaimed prior to modifying the mining permit for additional permit term
acreage. Reclamation will include a wildlife recreation and hunting area for the
northern two thirds of the property, and a 2 to 3 acre pond reclaimed from the
sand extraction area. Application materials are available for public review and
comment at the NYS DEC Regional Headquarters.
