The applicant proposes to reconstruct the Lower Reservoir dam and spillway located on the east side of Reservoir Road, approximately 0.6 mile north of the intersection with Black Rock Road.  The reconstruction will require replacement and widening of the existing spillway from 24 feet wide to 50 feet wide, raising the dam height approximately 4.5 feet from an elevation of 682 feet to 686.5 feet, replacement of the dam drain valve and intake pipe, and other miscellaneous repair measures.  No increase in the storage volume, area, or normal pool elevation of the 3.0 acre reservoir is proposed.  In addition, the work will involve approximately 300 linear feet of stream channel re-grading downstream of the dam within an unamed tributary of Wawayanda Creek (DEC Water Index No. H-139-13-61-9-20;  Class C(T)).  

        Sprint Spectrum LP, has applied for a Freshwater Wetlands permit to disturb up to 660 square feet of freshwater wetland "ML-7" (Class II) and its wetland adjacent area, by constructing ten 1-foot diameter concrete piers to support a 100-foot long elevated Cable-TV line and to construct a 12-foot by 4-foot by 4-foot high equipment platform.  The Cable-TV line will connect to an antenna on an existing 120-foot high ConEd Electric Transmission Tower (#K-236).  The project is located in an existing ConEd right-of-way off Lake Secor Road approximately 3 tenths of a mile east of the Taconic State Parkway in the Town of Putnam Valley, Putnam County, NY.  

The Department has made a tentative determination to approve this SPDES permit application for the continued surface discharge of up to 10,000 gallons of treated sanitary wastewater per day to an unamed tributary of the Esopus Creek (DEC Water Index No. H-171-10;  Class C).  The facility is located on the east side of Old Kings Highway, approximately 0.25 mile north of the intersection with Glasco Turnpike.  The facility and discharge currently exist and are authorized under an existing SPDES permit.  The sewage treatment system was recently replaced and a new SPDES permit has been drafted that would require compliance with more stringent effluent limitations than are currently required.  The permittee will be required to maintain records to verify compliance with the SPDES permit conditions and discharge limits.  A copy of the draft permit is available for review at the DEC Region 3 office.
