The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law(ECL) and the Title V of the Federal Clean Air Act Amendments, and made a tentative determination to approve this application for the applicant's existing solid waste landfill facility located at 3737 Long Beach Road, Oceanside, NY. The facility operates a closed municipal solid waste landfill. Waste was received in the landfill from 1961 through May 1988. The landfill has a gas collection system. The collected gas will be transferred to the Zapco-Energy Tactics Corporation(Zapco). Zapco uses the collected landfill gas as fuel in their electric generating internal combustion engines. Landfill gas primarily contain Methane and Non Methane Organic Compounds.  Regulated processes to be authorized under this permit consist of collection of landfill gas and monitoring of emissions. The application and draft permit are available for review at Region 1 office of the NYS Department of Environmental Conservation. The facility is subject to 6NYCRR Part 201, 208 and 40 CFR Part60.  Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. It is recommended that an appointment be made to confirm the availability of the subject files. The DEC will endeavor to make the files available within 2 business days of contact, during normal business hours(8:30 am through 4:45 pm), unless the requestor wishes to inspect the files at a later date. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. A public hearing may be legislative or adjudicatory. A legislative public hearing is a proceeding which provides an additional opportunity for public comment. DEC's determination to hold a legislative public hearing will be based on whether a significant degree of public interest exists. If a legislative public hearing is to be held, a Notice of Hearing will be published which will include the time and place of the hearing and submitting documents. The applicant and all persons who have filed comments on the permit will be notified by mail of the public hearing. Comments and requests for a legislative public hearing should be in writing and addressed to the Department representative listed below. An adjudicatory public hearing is a trial type proceeding which provides the opportunity for an adjudication on the basis of evidence, including direct testimony and cross examination. An adjudicatory hearing is held only if substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Conservation Law exist. The applicant proposes to construct several residential living units within approximately 90 feet of regulated freshwater #BW-1.  The proposed construction is associated with a project to construct 164 senior residential units with associated parking and appurtuances. The majority of the work is beyond the 100 foot jurisdictional limits of the Freshwater Wetlands Regulations.  The applicant proposes a vegetatively enhanced buffer zone to mitigate possible imapcts to the wetlands.  The project is located on Wyandanch Avenue, Wyandanch, Town of Babylon, Suffolk County.        

The applicant proposes to subdivide a 66,918 square foot parcel into two lots.  The seaward lot is to be 44,635 square feet and is developed with a single family dwelling and drive.  The landward lot is to be 25,283 square feet and contains a garage and drive. Portions of these lots are beyond the jurisdiction of Article 25.  The property is located at 23 West Meadow Lane, Stony Brook, Town of Brookhaven, Suffolk County, SCTM# 0200-152-4-9.   

The applicant proposes to remove portions of an existing gravel-surfaced driveway and parking area and to grade and clear a area located within the adjacent area of a regulated freshwater wetland designated MP-25.  This work would be done in association with the construction of a single family dwelling, including a deck and sanitary system.  The parking area which is to be removed is located within approximately 30 feet of the delineated freshwater wetland boundary, and grading and clearing preparatory to construction of the residence would be done within an area approximately 90 feet from that boundary.  Although the residence and associated structures would be located outside the adjacent area of  the freshwater wetland, the proposed work would be undertaken within the tidal wetland adjacent area associated with Lake Montauk.

The applicant proposes to construct a single family dwelling located partially within the adjacent area associated with the regulated freshwater wetland designated MP-30. Grading and clearing would be undertaken within 60 feet of the freshwater wetland boundary, and the southeast corner of the house would be located within 80 feet of that boundary. The accessory structures that are proposed, a detached garage, swimming pool, and septic system would be installed outside the adjacent area.  

The applicant proposes to subdivide a 31,500 square foot property into three lots.  Two of the lots are proposed to be 7,500 square feet in size and one lot is proposed to be 16,500 square feet in size.  The applicant has requested variances from the minimum lot size of 40,000 square feet which is required in the Tidal Wetlands Land Use Regulations. Two of the lots are proposed to be developed and the third is proposed to remain undeveloped.  The property is adjacent to regulated tidal wetlands known as the Atlantic Ocean.  The project site is located at Dehnhoff Road, Ocean Beach, Town of Islip, Suffolk County, SCTM #500-496-3-21.1,22 & 23.       

The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the New York State Environmental Conservation Law (ECL) and made a tentative determination to approve this application for the operation of the applicant's existing two external boilers and one ethylene oxide sterilizer. As a result of the permanent shut down of the facility's medical waste incinerator and acceptance of a federally enforceable permit condition to cap the facility's total oxides of nitrogen emissions (NOX) to be below the major source threshold of 25 tons per year, the facility becomes eligible to operate as an Air State Facility (minor source). The NOX cap will be accomplished by restricting the fuel consumption of natural gas to be below 296 million cubic feet and No. 2 fuel oil to be below 40,000 gallons per year. The draft Air State Facility permit includes conditions from the original Permit to Construct for the boilers and the sterilizer based on 6NYCRR Part 201-Permits, 6NYCRR Part 212-General Process Emission Sources, 6NYCRR Part 227-Stationary Combustion Installations. When these overlap, the permit contains the most stringent limits, which includes emissions limits, monitoring conditions and record keeping requirements.

Applicant proposes to install 2-4" PVC pipe, 1 quad duct and 12 shallow manholes along a 700' portion of  Cold Spring Point Road for telephone service improvements.  Project is located in the Fresh Water Wetland and adjacent areas of regulated Fresh Water WEtlands (SH-59,SH-18 and SH-17.  The project is also located within 300 feet of a regulated tidal wetland , Cold Spring Pond and is also under the jurisdiction of Article 25 (Tidal Wetlands).  Project is located along Cold Spring Road, Cold  Spring  Pond, Town of Southampton
