Project Description: The Department has drafted a permit pursuant to Article 19 (Air Pollution
Control) of the NYS Environmental Conservation Law(ECL) and the Title V of the
Federal Clean Air Act Amendments, and made a tentative determination to
approve this application for the applicant's existing solid waste landfill facility
located at 3737 Long Beach Road, Oceanside, NY. The facility operates a
closed municipal solid waste landfill. Waste was received in the landfill from
1961 through May 1988. The landfill has a gas collection system. The collected
gas will be transferred to the Zapco-Energy Tactics Corporation(Zapco). Zapco
uses the collected landfill gas as fuel in their electric generating internal
combustion engines. Landfill gas primarily contain Methane and Non Methane
Organic Compounds. Regulated processes to be authorized under this permit
consist of collection of landfill gas and monitoring of emissions. The application
and draft permit are available for review at Region 1 office of the NYS
Department of Environmental Conservation. The facility is subject to 6NYCRR
Part 201, 208 and 40 CFR Part60. Persons wishing to inspect the subject Title V
files, including the application with all relevant supporting materials, the draft
permit, and all other materials available to the DEC (the "permitting authority")
that are relevant to this permitting decision should contact the DEC
representative listed below. It is recommended that an appointment be made to
confirm the availability of the subject files. The DEC will endeavor to make the
files available within 2 business days of contact, during normal business
hours(8:30 am through 4:45 pm), unless the requestor wishes to inspect the files
at a later date. DEC will evaluate the application and the comments received on
it to determine whether to hold a public hearing. A public hearing may be
legislative or adjudicatory. A legislative public hearing is a proceeding which
provides an additional opportunity for public comment. DEC's determination to
hold a legislative public hearing will be based on whether a significant degree of
public interest exists. If a legislative public hearing is to be held, a Notice of
Hearing will be published which will include the time and place of the hearing and
submitting documents. The applicant and all persons who have filed comments
on the permit will be notified by mail of the public hearing. Comments and
requests for a legislative public hearing should be in writing and addressed to the
Department representative listed below. An adjudicatory public hearing is a trial
type proceeding which provides the opportunity for an adjudication on the basis
of evidence, including direct testimony and cross examination. An adjudicatory
hearing is held only if substantive and significant issues relating to any findings
or determinations the Department is required to make pursuant to the
Environmental Conservation Law exist. A copy of the Department's permit

In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator

compliance with applicable requirements of the Clean Air Act or 6NYCRR Part
201.

Project Description: The Department has drafted a permit pursuant to Article 19 (Air Pollution
Control) of the New York State Environmental Conservation Law (ECL) and
made a tentative determination to approve this application for the operation of
the applicant's existing two external boilers and one ethylene oxide sterilizer. As
a result of the permanent shut down of the facility's medical waste incinerator
and acceptance of a federally enforceable permit condition to cap the facility's
total oxides of nitrogen emissions (NOX) to be below the major source threshold
of 25 tons per year, the facility becomes eligible to operate as an Air State
Facility (minor source). The NOX cap will be accomplished by restricting the fuel
consumption of natural gas to be below 296 million cubic feet and No. 2 fuel oil
to be below 40,000 gallons per year. The draft Air State Facility permit includes
conditions from the original Permit to Construct for the boilers and the sterilizer
based on 6NYCRR Part 201-Permits, 6NYCRR Part 212-General Process
Emission Sources, 6NYCRR Part 227-Stationary Combustion Installations.
When these overlap, the permit contains the most stringent limits, which includes
emissions limits, monitoring conditions and record keeping requirements.
