Project Description:

The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the federal Clean Air Act Amendments, and made a tentative determination to approve this application for the modification of the applicant's existing Title V permit. The applicant operates a chemical manufacturing facility on NYS Route 63, two miles north of the Village of Geneseo, in the Town of York, Livingston County.

This Title V modification affects Building 8 emission unit P-ROC01and those processes that manufacture methyl ethyl ketone peroxides (MEKPs). The purpose of this project is to improve productivity in Building 8 in order to handle the plant's entire MEKP product demand. The project will involve the replacement of existing emissions source 08T06, the old batch stripper tank, with emission source 08T6N, a new batch stripper tank. The proposed modification will also include new control equipment 08K03 and 08K04 (brine condensers), which will replace the old brine condensers (emission sources 08K01 and 08K02). Additionally, some new packout equipment will be added (emission source 08P0N). The permit contains conditions that effectively cap the emissions from EP169 to below the 40 tons/year applicability threshold of 40 CFR 52 and 6 NYCRR Part 231 (New Source Review) by maintaining maximum temperatures of the 2nd condenser exit gas at +1 degree C or less. This is a more a more stringent exit gas temperature requirement than previously used. The VOC RACT requirements of 6 NYCRR Part 212 for the facility will continue to be met. EP 018, also associated with this emission unit, will not be affected by this modification.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. It is recommended that an appointment be made to confirm the availability of the subject files. The DEC will endeavor to make the files available within 2 business days of contact, during normal business hours (8:30 am through 4:45 pm), unless the requestor wishes to inspect the files at a later date.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. A public hearing may be legislative or adjudicatory. A legislative public hearing is a proceeding which provides an additional opportunity for public comment. DEC's determination to hold a legislative public hearing will be based on whether a significant degree of public interest exists. If a legislative public hearing is to be held, a Notice of Hearing will be published which will include the time and place of the hearing and submitting comments. The applicant and all persons who have filed comments on the permit will be notified by mail of the public hearing. Comments and requests for a legislative public hearing should be in writing and addressed to the Department representative listed below.

An adjudicatory public hearing is a trial type proceeding which provides the opportunity for adjudication on the basis of evidence, including direct testimony and cross examination. An adjudicatory hearing is held only if substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Conservation Law exist. Pursuant to Best Management Practices design for compliance with the GP 93-06 SPDES General Permit for Storm Water Discharges From Construction Activities, the applicant proposes to construct two storm water ponds in the adjacent area of NYS DEC regulated Freshwater Wetland FA-6 (Class III) in conjunction with the development of a 19-lot residential subdivision. The site is located west off of the Victor-Egypt Road, approximately 700' south of the Monroe County border. Project Description:

The applicant operates an industrial facility located on Perry Point Road where they produce inorganic material for the surface finishing of glass and plastic , and ceramic materials. A request has been received to modifiy the wastewater discharge permit for the discharge to Seneca Lake. The proposed modification eliminates outfall 003 , adds non-contact cooling water and storm runoff to outfall 001, combines outfall 002 with outfall 001, and redesignates outfall 003 as a new outfall 002. The permit effluent limits are converted from concentration values to mass values for the new outfall 001. A draft permit is available for review.
