Project Description:

The Cornwall Central School District has applied for a 401 Water Quality Certification to place fill material into a maximum of 0.423 acres of federally designated wetland for the construction of the new Cornwall Central High School which would be located on a 50 acre parcel of land off NYS Rt 94. The School District also proposes to mitigate the loss of wetlands by the creation of 0.5 acres of new wetland. They would also temporarily disturb 0.01 acres of federal wetland in order to install an 8-inch diameter water line. The US Army Corps of Engineers has primary jurisdiction over federally designated wetlands and has determined that the fill and the water line are eligible for the Army Corps of Engineers' Nationwide General Permits #39 (Fill) and #12 (Utility Line). The project is located on NYS Rt 94 opposite Mt Airy Road, approximately 0.7 miles west of the NYS Thruway, in the Town of Cornwall, Orange County, NY.

State Environmental Quality Review (SEQR) Determination: A draft environmental impact statement has been prepared on this project and is on file.
SEQR Lead Agency: Cornwall Ctl Sch Dist
State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment: Comments on this project must be submitted in writing to the Contact Person no later than Mar 1 2002.

Project Description:

The Department has prepared a Draft Permit (#NY-0166511) and has made a tentative determination to approve a Department-initiated modification of the existing SPDES permit for the Al Turi Landfill. Currently the Al Turi Landfill has a SPDES permit to discharge treated landfill leachate and treated stormwater runoff from the landfill into the Wallkill River. The modifications would not change this activity but would incorporate the following additional monitoring:

--Page 2, adding a new definition sheet;

--Pages 4 & 5, adding additional parameters to Outfalls 002 & 003 (the stormwater outfalls) based on sampling data collected by the Department's Division of Solid Waste staff from Stormwater Basins "A" and "B" between July 1998 and July 2001;

--Pages 7 and 8, adding a requirement for the posting of a sign at each outfall pipe in accordance with the Discharge Notification Act;

--Page 9, adding a compliance schedule containing a 10-month deadline for conducting a sampling program for the parameters listed in the newly promulgated federal regulation 40 CFR 445 "Landfills Point Source Category" but which are not already required in their current permit. These include Alpha Terpineol, Benzoic Acid, P-Cresol (using EPA Method 625) and Toluene.

The Al Turi Landfill is located at the intersection of NYS Rt. 17M and Hartley Road in the Town of Goshen, Orange County, NY.

State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
