Project Description:

The applicant requests a modification to its Mined Land Reclamation Permit to excavate a 22 acre lake within the existing, permitted mine area. Approximately 2,000,000 cubic yards of sand and gravel are proposed to be mined from the lake area during an estimated period of 10 to 20 years. The mine site and existing mineral processing area are located on the west side of US Route 9 approximately 1000 feet north of the Dutchess/Putnam County boundary.

The Department has made a tentative determination to approve this application to modify a SPDES permit with surface discharge of 21,000 gallons per day (Outfall No. 001) of treated sanitary wastewater to an unnamed tributary to Ice Pond (Class C) from the Henry H. Wells Middle School. The permit modification allows the future consolidation of three surface discharges from the applicant's school complex (Henry H. Wells Middle School, John F. Kennedy Elementary School and Brewster High School) into one combined surface discharge from an existing outfall located at the Brewster High School (SPDES No. NY-0029521; DEC No. 3-3730-00108/00001). The future consolidation of the three surface discharges will occur following completion of wastewater treatment plant upgrades and will discontinue surface discharges from the Henry H. Wells Middle School and the John F. Kennedy Elementary School. The modification reflects construction of a new wastewater treatment plant (WWTP) in order to meet requirements of the NYC Watershed Rules & Regulation (WR & R). There will be no increase in volume of this discharge to surface water and there will be no over-all increase in volume of the combined discharges to surface water from the three schools as a result of the project. The project is located on the north side of NYS Route 312 east of Farm to Market Road (County Route 62) in the Town of Southeast, Putnam County. A draft permit is available for inspection and comment at the regional office.

The applicant proposes to disturb approximately 0.35 acres of the regulated 100-foot adjacent area of State-designated Freshwater Wetland No. W-3 (Class II) for the construction of a proposed hotel. The project site is located on the south side of White Plains Road (NYS Route 119) approximately 4,000 feet west of the interchange with Interstate 287. The project involves the construction of a 145-room hotel to be known as Springhill Suites. The proposed disturbance of the wetland adjacent area includes the installation of water and sewer lines along NYS Route 119, and the clearing, grading and lanscaping of areas within 30 feet of the proposed structure.

State Environmental Quality Review (SEQR) Determination: A draft environmental impact statement has been prepared on this project and is on file.
SEQR Lead Agency: Greenburgh Town Board
State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
