Project Description:

The Department has prepared a draft permit and has made a tentative determination to approve this application. The existing Con Edison facility produces electricity and steam. It operates three boilers rated at 688 MMBtu/hr and one rated at 664 MMBtu/hr. The boilers combust residual oil. The facility operates three combustion turbines each rated at 235 MMBtu/hr. The turbines combust distillate oil. One combustion turbine is equipped with a diesel starter engine. The facility emissions exceed the major facility threshold levels for NOx, SO2, CO, particulates and VOCs.

In accordance with 6 NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6 NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. It is recommended that an appointment be made to confirm the availability of the subject files. The DEC will endeavor to make the files available within 2 business days of contact, during normal business hours (8:30 am through 4:45 pm), unless the requestor wishes to inspect the files at a later date.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. A public hearing may be legislative or adjudicatory. A legislative public hearing is a proceeding which provides an additional opportunity for public comment. DEC's determination to hold a legislative public hearing will be based on whether a significant degree of public interest exists. If a legislative public hearing is to be held, a Notice of Hearing will be published which will include the time and place of the hearing and submitting comments. The applicant and all persons who have filed comments on the permit will be notified by mail of the public hearing. Comments and requests for a legislative public hearing should be in writing and addressed to the Department representative listed below.

An adjudicatory public hearing is a trial type proceeding which provides the opportunity for adjudication on the basis of evidence, including direct testimony and cross examination. An adjudicatory hearing is held only if substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Law exist. State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

In Queens County, at the above address, modify the physical plant and operation of the subject facility and change the Applicant's authorized waste stream from 500 tons per day (TPD) of putrescible solid waste (PSW) sand 500 TPD construction and demolition debris (C&D) to 900 TPD PSW, 50 TPD C&D, and 50 TPD sewage grit and screenings. As a result of this modification, the total daily amount of authorized waste received by the facility would not increase, truck traffic would not increase, on-street queuing would decrease, the amount of C&D stored on-site at any one time would decrease, and the Applicant would install enhanced odor controls.

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

Project Description:

Regal Recycling Co., Inc is an existing solid waste transfer station and recycleables handling and receiving facility authorized under to handle putrescible waste and construction and demolition debris. The applicant proposes a modification to the existing permit to increase handling throughput capacity for the management of putrescible solid waste from 355 cubic yards per day (177.5 tons) to1200 cubic yards per day (600 tons) and maintain the existing permitted throughput capacity for construction and demolition debris of 355 cubic yards (266 tons). The on site storage of construction and demolition debris will be reduced to 2000 cubic yards per day.

The proposed increase in putrescible waste throughput will result in a maximum 10 truck trips, total during peak hour of operation. The applicant proposes to remove the on street queuing of trucks or vehicles associated with the operation of the facility by maintaining a truck staging area proximate to the site and creating queuing spaces within the facility building. Existing truck traffic patterns will change to direct inbound trucks for the facility to Douglas Avenue. Proposed operations would be conducted within a fully enclosed building. Odor and dust suppression mechanisms shall be employed to retain and control nuisance conditions on site. The applicant proposes the operation of the facility for six days of the week, Monday through Saturday.

NYC Department of Santiation and NYS Department of Environmental Conservation, pursuant to a Stipulation Order in the Matter of the City of New York v. The New York State Department of Environmental Conservation are SEQRA Co-lead agencies for NYC applications involving solid waste management transfer stations.
