Positive Declaration and Notice of Acceptance of Draft EIS and Public Hearing

Tioga County - The Tioga County IDA, as lead agency, has determined that the proposed Nichols Distribution Center and Site Development may have a significant adverse impact on the environment and a Draft Environmental Impact Statement has been prepared. A public hearing on the Draft EIS will be held on February 5, 2002 at 4:00 p.m. at the Nichols Town Hall, 54 East River Road, Nichols, New York. Written comments on the Draft EIS will be accepted until February 18, 2002. The proposed action includes the development of an approximately 151-acre site for the purpose of constructing a 1.6 million square foot warehouse and regional distribution center to be completed by Best Buy, Inc. The project includes improvements to local infrastructure by Tioga County to support the development. The project is located immediately east of Exit 63 of NYS Route 17 and south of Stanton Hill Road in the Town of Nichols, Tioga County, New York.

Notice of Acceptance of Final EIS

Onondaga County - The Town of Clay, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Second Amendment Application for a Zone Change for Amerada Hess Corporation and Pitcher Hill Associates. The action involves a change of zone for approximately 8.9 acres from Apartment (R-4) District to Gasoline Facilities (C-4) District (1.8 acres) and Office (C-1) District (7.1 acres). The project is located on the southeast corner of Bear and Buckley Roads.

Tioga County - The New York State Department of Environmental Conservation, as lead agency, has accepted a Final Environmental Impact Statement on the proposed F.S. Lopke Contracting, Inc. Day and Buck/Wheeler Day Mines. The applicant proposes to mine sand and gravel from two new sites (the Day Pit and the Buck/Wheeler/Day Pit) located on both the north and south sides of NY Route 17 in the Town of Nichols, Tioga County, about three miles west of Owego, on the south side of the Susquehanna River.

Day Pit - DEC #7-4928-00023/00001
Sand and gravel will be excavated from the site and transported off-site for processing. The excavation will impact 71 acres of a 95-acre area. The proposed excavation will produce two pits, a smaller pit approximately 20 feet deep and a 48-acre lake approximately 55' deep. The site is on the south side of River Drive, between the Southern Tier Expressway (NYS Route 17) and the Susquehanna River.

Buck/Wheeler/Day Pit - DEC #7-4928-00031/00001
Sand and gravel will be excavated from 131 acres of a 244-acre site. A 61 acre lake with a maximum depth of 30' would be created. The project includes processing of materials on-site. The proposed project parallels approximately 4,800' of NYS Route 17C and is located between the Southern Tier Expressway (NYS Route 17) and Stanton Hill Road.
