Project Description:

The Department has prepared a Draft Permit and made a tentative determination to modify SPDES Permit No. NY-0203335 which has an existing discharge to the Niagara River (Class A Special), of 3.56 million gallons per day (average) from three outfalls of furnace contact and noncontact cooling water, river water strainer backwash, and stormwater runoff. The changes to the permit include: (1) Outfall 001, higher interim action levels and final limits replace present action levels for aluminum and boron. A compliance schedule has been included requiring the permittee to submit a proposal to achieve final compliance, (2) Add Outfall 001 for the discharge from the boron carbide washing operation with the for which interim and final limits and action levels as well as the proposed compliance schedule will apply, (3) Outfall 004, Action Levels for Aluminum and boron have been modified. The facility is located at 1801 Buffalo Ave. A draft permit is available for review at the NYSDEC Region 9 Office.

State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment: Comments on this project must be submitted in writing to the Contact Person no later than Feb 18 2002.
