Project Description:

The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of Federal Clean Air Amendments and made a tentative determination to approve this application for the applicant's existing commercial facility. -The Tosco Corporation- Riverhead Terminal- facility stores and distributes crude oils, gasoline, gasoline blendstocks, diesel fuel, distillate and residual fuel oils, with sulfur contents limited to 1.5 weight percent. Products are stored in 20 tanks and are subject to 6 NYCRR Part 212 (General Process Emission Sources) regulations. Tanks 14-19 and 21 have capacities between 250,000 and 580,000 barrels, are subject to 40 CFR 60 Subpart K,Kb (Standards of Performance for Volatile Organic Liquid, Including Petroleum Liquid, Storage Vessels) and 6 NYCRR Part 229 (Petroleum and Volatile Organic Liquid Storage and Transfer) regulations. The facility operates 3 steam boilers of 29 million Btu/hr each. The annual fuel oil consumption is limited to 2,400,000 gallons, each boiler is subject to an annual tune-up and stack opacity limitation. Seven diesel engines rated between 335 and 425 hp are used for pumping fuel liquids between onshore storage tanks and offshore loading/ unloading platform and barge pier. The Department granted variances for volatile organic compounds emissions from marine loading/unloading platform and nitrogen oxide emissions from Beach 1,2, and Section A diesel engine pump drives. The variances restrict marine loading of vessels to less than 5,000,000 barrels of petroleum products per year and diesel engine emissions below 10 grams per brake horsepower-hour to be re-evaluated yearly.

The application, draft permit, and relevant supporting materials and regulations are available for review during normal business hours at the Regional DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. NYSDEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objection raised. Hearing notices will contain instructions on filing for party status and submitting comments. In accordance with 6 NYCRR part 621.6(d)(9) and 201-6.4(c), the Administrator of the US Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V facility permit if it determined not to be in compliance with the applicable requirements of the Clean Air Act or 6 NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. It is recommended that an appointment be made to confirm the availability of the subject files. The DEC will endeavor to make the files available within 2 business days of contact, during normal business hours (8:30 am through 4:45 pm), unless the requestor wishes to inspect the files at a later date.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. A public hearing may be legislative or adjudicatory. A legislative public hearing is a proceeding which provides an additional opportunity for public comment. DEC's determination to hold a legislative public hearing will be based on whether a significant degree of public interest exists. If a legislative public hearing is to be held, a Notice of Hearing will be published which will include the time and place of the hearing and submitting comments. The applicant and all persons who have filed comments on the permit will be notified by mail of the public hearing. Comments and requests for a legislative public hearing should be in writing and addressed to the Department representative listed below.

An adjudicatory public hearing is a trial type proceeding which provides the opportunity for adjudication on the basis of evidence, including direct testimony and cross examination. An adjudicatory hearing is held only if substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Conservation Law exist.
