THE PROJECT WILL BE LOCATED MORE THAN 100' FROM A REGULATED FRESH WATER WETLAND AND IS CONSIDERED BEYOND THE JURISDICTION OF ARTICLE 24 (FRESH WATER WETLANDS).

Project Description:

The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and made a tentative determination to approve this application for the applicant's existing fiberglas-reinforced acrylic and polyester press molding process facility. The facility operates three production lines for laying and press molding. These lines vent through emission point # 1 and the mixing vats vent through emission point # 2. Both emission points belong to the facility's emission unit # 1. The facility is subject to 6NYCRR Part 228 (Surface Coating Processes) and 6NYCRR Part 212 (General Coating Processes). The Permit will cap the emissions of Volatile Organic Compounds (VOC) and Hazardous Air Pollutants (HAP) below 22.5 tons per year. The emission of methylacrylate is capped at 9 tons per year. Therefore, the facility will be excluded from the Title V facility permitting requirements under the Clean Air Act Amendments of 1990 and 6NYCRR Part 201. The Department has prepared Federally enforceable draft permit conditions that limit emissions and require permit record keeping to document compliance. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

The applicant proposes to install a 112 linear foot vinyl retaining wall along the toe of the embankment and 50-200 pound stone armor at the eastern end of the retaining wall; dredge an approximate 20 foot by 60 foot shoal to 4 feet below apparent low water with resultant approximate 75 cubic yards of material to be used as backfill for the retaining wall; and install a 4 foot by 17 foot catwalk, 3 foot by 14 foot ramp, and 6 foot by 20 foot float. The proposed upland development consists of a two-story single family dwelling, garage, sanitary system, pervious driveway, and public water.
